Forum directs airways to refund ticket amount Ludhiana, May 26 The orders were pronounced by the forum while deciding the complaint filed by Ms Sunita Dhanda of Sarabha Nagar. The forum directed the company to comply with the orders within one month from the receipt of the copy of the order. The forum allowed the airways to deduct the amount, if any, as per rules and regulations. The complainant had submitted that she had approached Ajanta Airlines Service near the local bus stand for the purchase of a return air ticket from New Delhi to London. Her passport and visa for the United Kingdom from May 6, 2001, to December 6, 2001, was retained for the purpose of purchasing the air ticket. On December 3, Ajanta Airlines Service provided her the air ticket and charged Rs 46,526 as the cost of the ticket. As per the ticket issued, the departure time of the plane from New Delhi to London was 2 pm on December 6. She reported at the Indira Gandhi International Airport, New Delhi, before the scheduled time and a
boarding pass was issued by the airport authorities after checking the luggage. Officials of Virgin Atlantic Airways did not allow her to board the plane on the ground that her visa was to expire on December 6 at 12 midnight. The fact regarding the expiry of visa was in the knowledge of the opposite parties at the time of issuing the ticket because the ticket was issued after the perusal of passport and visa, added the complainant. The complainant had alleged that the act amounted to deficiency in services, which caused mental torture and harassment to her. She had demanded the refund of the amount charged for the ticket and Rs 2 lakh as compensation. Upon issuance of notice by the forum, Virgin Atlantic Airways had not contested the case and it was proceeded ex-parte. Denying deficiency in services, Ajanta Airlines Service had admitted the facts regarding the issuance of ticket. After perusing the material placed on record, the forum found that there was no fault of Ajanta Airlines Service as it had purchased and delivered the ticket to the consumer. The forum observed that there was deficiency in services on the part of Virgin Atlantic Airways, which had issued the ticket. |
