Deficient service plea against PGI Director fails

The UT State Consumer Disputes Redressal Commission today dismissed a complaint filed by city resident H.S. Tuli against the Director of Post Graduate Institute of Medical Education and Research, besides Dr V.K. Khosla, Dr Promila Chari and Dr Kajal Jain.

The Commission, headed by President Justice K.K. Srivastava, held that the complainant had failed to substantiate the allegations made in the complaint regarding alleged negligence and deficiency in service which allegedly led to the death of Mohinder Kaur at the Institute on March 14, 2001.

Mr Tuli, the husband of the deceased, had earlier claimed that due to alleged negligence and carelessness by doctors, and due to deliberate acts and omissions, he had lost his life partner.

The complainant had claimed refund of Rs 50,000 expenses, besides compensation of Rs 2 lakh for the attendants, along with further claim of Rs 5 lakh for the loss of income and Rs 10 lakh for damages due to mental discomfort, harassment, loss of life partner, perpetual trauma and agony.

Mr Tuli had further alleged that the doctors did not perform open brain surgery for clipping aneurysms of his wife on March 9 and 10 last year, despite his repeated requests because of which her condition deteriorated and she ultimately died.

The institute, through Mr Anil Malhotra, contended that the deceased patient could not be operated upon since the attendants had not give written consent for open brain surgery.

The aneurysm clips mandatory for open brain surgery were not purchased as a consequence thereto. Therefore, neither any negligence nor any deficiency in service was either proved or established against the PGI doctors.

The Commission, after examining the evidence led by Dr Navdeep Singh Khaira and Mr Tuli, held that the inference which flowed was that the attendants of the patient were trying to seek opinion from outside the institute. The PGI record showed that no consent was given for the open brain surgery of the patient at the institute.

The evidence of Dr V.K. Khosla proved that despite persistent request, no consent was given and hence there was no occasion to perform open brain surgery at the institute due to high risks involved in the patient’s condition. The operation theatre and other staff was kept ready and all preparations for the operation were made in anticipation for the consent being received from the attendants.

The Commission held that Dr Khosla did not himself postpone the open brain surgery of the patient but it was the indecisiveness on the part of the attendants to seek second opinion for endovascular procedure.

The Commission came to the conclusion that there appeared to be no valid reason for the PGI doctors to avoid the open brain surgery of the patient. The Commission also recorded that Dr Chari and Dr Jain were not negligent or deficient in rendering services left to bear their own costs themselves.

St. Soldier School eves win

St Soldier’s International Public School, Sector 28, and Government High School, Sector 11, outplayed their respective rivals Shishu Niketan Senior Secondary School, Sector 22 and Government Model High School, Sector 28, by 1-0 and 2-1, respectively, in the First Chandigarh Sub-Junior Girls Football Championship for below 16 years, which began here today at the Shivalik Public School, Sector 41, grounds.

There were four matches scheduled for the day, out of which two were walk overs. St Peter’s School, Sector 37, was given walk over by Government Senior Secondary School, Sector 20, while in the second tie, Saupin’s School, Sector 32, was given walk over by Mount Carmel School, Sector 47.

In the match played between St. Soldier’s and Shishu Niketan School, no goal was scored till the half time. St. Soldier’s missed golden chance in 10th minute when their right striker Monika Sharma failed to score a goal. After the lemon break, St Soldier’s eves dominated the attack and it was Sat Preet Kaur Saini who scored the match winning goal in 30th minute on a pass given by Monika.

In the second match played between GHS-11 and Government Model High School, Sector 28, the half time score was 1-0 in favour of GHS-11. Though GHS-11girls had an edge over their rivals but in the 17th minute, due to a lapse on the part of the defencers, a goal was scored by GMHS-28 eves. After the half time, Sunita came forward to score another goal in the 26th minute with her sole efforts.

Boxing association

Mr Satish Chandra, IAS and Mr C.K. Jerath were unanimously re-elected as President and Secretary General of the Chandigarh Amateur Boxing Association in its meeting held today.

Mr R. Sharan and Mr K.S. Bharti, attended the meeting as observer from the Chandigarh Olympic Association and the Chandigarh Sports Council, respectively.

The office-bearers are: senior vice-presidents — Dr Dinesh Thakur, Dr S.K. Thakur and Ms Manju Bhardwaj; joint Secretaries — K.I.P Singh, H.K. Sharma and Bikram Singh Rana; treasurer — B.S. Virk; executive committee — Prof Balraj Thakur, Harsh Kumar, R.S. Brar, J.P. Singh, H.G. Mandal and Kamajit Saini.

Sacred Heart wins

Sacred Heart Senior Secondary School, Sector 26, downed Government Model School, Sector 44 (3-0) while Mount Carmel, Sector 47, got the better of Moti Ram Arya Senior Secondary School, Sector 27 (3-0) in the girls under-14 section of the UT Inter-School Carrom Tournament for girls which began at the St. Stephen’s School, Sector 45.

In the girls under-17 section, GMSS, Sector 44, defeated Sacred Heart Senior Secondary School, Sector 26 (3-0) while Mount Carmel School, Sector 47, beat Moti Ram Senior Secondary School, Sector 27 (3-0).

In the girls under-19 section, Sacred Heart School, Sector 26 outplayed GMSSS-44 (3-0) while St Joseph School, Sector 47 defeated Sector 20 (2-1).

Inter-school B’ball

Hosts Sri Guru Harkishan Model School, Sector 38, and Vivek High School, Sector 38, surged ahead by posing comfortable wins over their respective rivals in the Sri Guru Harkishan Invitational Basketball Tournament played here today on the school premises in Sector 38.

The results are: SGHP-38 b GMSSS-16 (34-30); Vivek High school-38 b New Public-18 (38-30); SGHP-38 b GMSSS-26 (38-30); Vivek High-38 b GMSSS-16 (38-24) and New Public School-18 b St Xavier’s-44 (36-32).

Powerlifting team

A six-member Chandigarh Powerlifting team has been selected by the Chandigarh Powerlifting Association to represent UT in the senior men and women National Powerlifting Championship going to be held at Mangalore (Karnataka) from August 25 to 29.

According to Mr H.S. Bansal, secretary of the association, the team, includes Hussan Lal, Romesh Kumar, Suraj, Paramjit Singh, Hari Chand, Gurwinder Singh and Sandeep Singh. Rapal Singh and Manjot Singh will accompany the team as coach and manager, respectively.

Cricket academy wins

Yog Raj Singh Cricket Academy defeated Satluj Coaching Centre by eight wickets in the Friendship Under-14 Cricket Tournament played here at Sector 4.

Brief scores: Satluj Coaching Centre: 120 runs for four in 25 overs (Rohit 46, Nitish Bhardwaj 42, Tanveer 18, Yudhishter 2 for 17). Yog Raj Cricket Academy: 122 runs for two in 21.3 overs (Gurkirat 61 n.o., Manan Vohra 17.

Wrestling contests

In the wrestling competitions organised by Gugga Maddi Committee, Dadu Majra village and village panchayat, more than 200 wrestlers took part. In the competition bout between Sohan Singh, Madhuban and Rakesh Kala of Indore, it was tough competition which lasted 45 minutes but both were adjudged winners.

On this occasion, the committee also honoured Baba Talu Singh Saini, Sarwan Singh and former Hind Kesari Sharsher Singh.
