ASI directed to end encroachments New Delhi, May 26 Taking a strong view of the blatant encroachments and commercialization of historic sites, the Delhi High Court has directed the Archaeological Survey of India (ASI) to remove the encroachments in and around the two-centuries-old protected monuments in Panchsheel Enclave area of New Delhi. A Division Bench, comprising Chief Justice S B Sinha and A K Sikri, ordered the ASI to take appropriate action for removal of encroachments in and around ‘Lal Gumbad’ and ‘Madarsa Zeenatul’, which fell in a green belt. A public interest petition, filed by the Panchsheel Enclave Residents Welfare Association, had highlighted the illegal constructions and unauthorised occupation of the monuments. The petition, among other things, claimed that the monuments had been virtually converted, after full-scale construction, into buildings for commercial activities in the garb of running a religious school by members of a particular community. The court had also told the Delhi Development Authority to take action for removing the encroachments from the site earmarked for a District Park and ensure that no construction activity was carried out. The area deputy commissioner of police had been ordered to extend all possible assistance to the ASI and DDA in executing the order. The bench ordered that appropriate action be initiated by the authorities within two months and action taken reports filed in the court. The judges made it clear that in case any further construction takes place around the monuments, the Deputy Commissioner of Police as well as the officials concerned of the ASI and the DDA would be personally held responsible for it. The resident association was at liberty to approach the court again if the orders were not implemented, they said. The association had earlier approached various authorities about the problem but to no avail. |
