Concorde Motors told to repair car
Tribune News Service

LUDHIANA, Nov 11 — The District Consumer Disputes Redressal Forum has directed Concorde Motors Ltd here to remove all defects in a car owned by Mr Ashwani Kumar Bhatia, a local resident.

The motor company has also been directed to provide a free service of the car for the period of six months after removing all defects. The delivery of the car is to be made within 15 days.

The direction to the company has been given on the complaint of Mr Bhatia. In his plea he stated that he had purchased a Tata Indica from a person on December 2, 1999. The said person had purchased the car just few weeks back. However, the car developed several defects after some days and he took the car to the company but the defects were not removed.

After dilly-dallying the company replaced its shockers and tyres but charged Rs 723 from the complainant even though the car was still within the warranty period.

The complainant also stated that after the said repairs he discovered that he had been cheated as the company did not repair the car but replace some original parts. The car was still having some defects and was not roadworthy. There was defect in its steering, AC and stereo. Even the tyres which were replaced were of second quality.

Claiming that he had been immensely harassed, the complainant demanded a new car and a compensation of Rs 60,000 in total.

The company, however, denied all allegations levelled against it. It said the car was repaired several times and the complainant was satisfied. The company also said that the complainant had purchased the car from some other person and had involved the company into the sale deed as per the rules.

After hearing both the parties, the forum found that there was no manufacturing defect in the car and thus it cannot be replaced with a new one as demanded by the complainant. However, it directed that the company should remove all defects. It also directed the complainant to take the delivery of the car within 15 days.
