Consumer Courts
HUDA told to allot plots
Tribune News Service

PANCHKULA, Dec 28 — The District Consumer Disputes Redressal Forum has ordered the Haryana Urban development authority to allot an alternative 10-marla plot in Sector 1 of Shahabad to Mr Pawan Kumar, a resident of Kurukshetra, pay Rs 25,000 as compensation and Rs 1,000 towards cost of proceedings.

The complainant stated that he was allotted a plot in Sector 1, Shahabad, in 1986 and he deposited the entire cost of the plot with HUDA. After repeated requests, he was offered possession of the plot in 1995.

However, till 1997 the sector remained undeveloped and he was unable to know the location of his plot. Also, he alleged, that when he did visit the site allotted to him he found that the cremation ground was hardly 10 metres away from his plot. He was also informed that the site allotted to him could not be changed in spite of the fact that HUDA had not shown any cremation ground in the layout plan.

In its reply, HUDA stated that the complainant did not visit the office for obtaining possession and added that the plot was far away from the cremation ground, while adding that the cremation ground was also being shifted to another place as per the decision of a higher court and that the allotment was made on the basis of the approved layout plan.

The bench, in its order, observed that the plot offered by HUDA for possession was right in front of the cremation ground and not fit for human habitation. Hence, the complainant was entitled to an alternative plot in lieu of the one allotted to him.

In another case, the forum has ordered HUDA to allot a plot to Mr Vijay Kumar, a resident of Panchkula, in Sector 8, Faridabad, or an alternative plot of the same size and at the same price in Sector 30, pay Rs 10,000 for mental agony and harassment and Rs 2,000 as cost of litigation.

In his complaint, Mr Vijay Kumar alleged that he was allotted a residential plot measuring 10 marlas in Sector 8, Faridabad, in 1985. In a letter to HUDA in 1995, he asked for possession of the plot or allotment of an alternative one in Sector 30. However, no action followed despite repeated requests.

In a written statement, HUDA said that the plot in question was allotted to Mr H.L. Dhawan in 1973 but was resumed by the Estate Office in 1976 after which it was allotted to the complainant from the discretionary quota even though Mr Dhawan filed a petition in court, making the matter sub judice. It was added that an alternative plot in Sector 30 would be allotted to the complainant shortly.

The bench comprising Mr R.C. Taneja, President, and Mr B.S. Badhran, member, observed that non-allotment of the plot after a gap of 14 years tantamounted to deficient services.Back
