Uproar in AP House over Telangana Bill
Hyderabad, December 16 Legislators from coastal Andhra and Rayalseema regions tore off and set afire copies of the bill. Chief Minister N Kiran Kumar Reddy, who had vowed to stall the state’s bifurcation, was conspicuous by his absence when the bill was introduced. Official sources said he was unwell. Leader of the Opposition and Telugu Desam Party (TDP) president N Chandrababu Naidu, who has also been opposing the manner in which the state is being divided, also kept himself away from the proceedings. Heated arguments took place between members of the Telangana Rashtra Samithi (TRS) and YSR Congress Party (YSRCP). Earlier, as soon as the House assembled for the day’s proceedings, TDP, TRS and YSRCP MLAs stormed the Speaker’s podium, raising slogans for and against the division of the state. While Telangana members, cutting across the party lines, wanted the bill to be taken up for debate without any delay, the Seemandhra members opposed its introduction. The YSRCP members insisted that the House first pass a resolution in favour of keeping the state united. Speaker Nadendla Manohar was forced to adjourn the House for an hour. On reassembling, the process of tabling the draft bill was pushed through quickly before Manohar adjourned the House again. Legislature secretary S Raja Sadaram, following instructions from the Speaker, laid the copies of the 65-page draft Bill on the table of the House and read out the reference of President Pranab Mukherjee sent to the state on December 12. The tabling of the bill drew cheers from the Telangana MLAs, including Deputy Chief Minister D Rajanarasimha, while those from Seemandhra region raised slogans against the division of the state. The President referred the bill to the state legislature eliciting its views by January 23. The Bill was tabled under Article 3 of the Constitution. The Speaker announced that the draft Bill was tabled as per Chapter 16 of the Assembly rules. There would be no voting on the provisions of the bill, and as such, the outcome of the discussion on the bill would have little impact on the decision to divide the state. The UPA leadership has already made it clear that the opinion of the state assembly would not be binding on the Centre and that Parliament alone has the power to create new states. TRS floor leader in the Assembly E Rajender and senior party legislator T Harish Rao, condemning the conduct of Seemandhra members, asserted that it was time that they realise that Telangana was a reality. “Nothing can stop the creation of Telangana state now. It is unfortunate that the opposition members from Seemandhra members are behaving the way they are since the draft bill has been sent by the President, who is the highest Constitutional authority in India,” they said. BJP wins R’sthan’s Churu seat
Jaipur, December 16 RS Rathore got 84,100 votes, while Maqbool bagged 60,098. Chief Minister Vasundhara Raje's loyal Rathore was also a sitting MLA from Taranagar assembly constituency but he changed his seat and
the party fielded him against Mandelia. Voting for the Churu seat was postponed following the demise of BSP candidate Jagdish Meghwal and polling with 78.55 per cent was held on December 13. Polling in 199 seats was held on December 1, in which BJP swept the state assembly polls bagging 162 seats. Congress won 21 seats, while BSP got three seats. NPP won four seats, while seven seats went to Independents and two went to others. BJP's state chief Vasundhara Raje was sworn in as the Chief Minister of Rajasthan on December 13. The Cabinet formation is still pending. BJP's Parliamentary board meeting held in Delhi yesterday was to finalise a panel of MLAs to be inducted into the Raje cabinet. Due to Union Minister of Labour Sis Ram Ola's death and his cremation today, the Cabinet formation may be held on December 18, the party sources hinted.

Lalu walks out of jail, trains gun on BJP
Ranchi, December 16 He was granted bail by the Supreme Court last Friday after two-and-a-half months of being convicted. Soon after stepping out of the jail, Lalu sounded a battle cry against the Bharatiya Janata Party (BJP) ahead of the Lok Sabha elections. Dressed in a grey kurta with a dark blue sweater over it, the 66-year-old former Bihar Chief Minister came out of the main gate and paid obeisance to tribal icon Birsa Munda on the jail premises in the Jharkhand capital. As hundreds of RJD supporters greeted him on his release, Lalu said he would chase away “communal elements” trying to make inroads into Delhi. “The communal elements want to have their stranglehold on Delhi. (With my release) I am now free to chase them away. I will go around the country to strengthen the secular forces and Narendra Modi, BJP or RSS will not be allowed to fulfil their dreams,” Lalu told reporters at the jail gate. When asked about the BJP's Prime Ministerial candidate, Lalu said: “Narendra Modi, or whichever Modi. I am here now; I am ready.” Prasad claimed that the country’s fate hung in balance as 2014 would “decide” whether “Bharat will splinter or remain united”. “I urge parties with secular credentials and their leaders not to allow this happen. I urge them just to rewind to the time of 1947 when the country was partitioned. I will throw my full weight behind secular forces (to make India united),” he said. Continuing his diatribe against “communal” forces, Lalu said, “The communalists will be displaced from Hastinapur,” (a mythological place referred in Mahabharata). Lalu’s first trip after his release was to the Deori temple at Tamar, about 40 km from Ranchi. Lalu warned his opponents not to make the mistake of thinking he is finished with electoral politics. The RJD chief, former Bihar Chief Minister Jagannath Mishra and 43 others were on September 30 convicted by a special CBI court in the fodder scam involving fraudulent withdrawal of Rs 37.7 crore from Chaibasa Treasury during the Lalu-led RJD regime. On October 3, the court had sentenced Lalu to five-year imprisonment and had slapped Rs 25 lakh fine on him.

New Delhi, December 16 Spiritual guru Asaram Bapu is facing charges of sexually assaulting a minor. Jairam Ramesh was replying to a question on Modi's criticism of Rahul Gandhi on the issue of Lokpal bill at a rally in Uttarakhand Sunday. Modi questioned why Congress, which is now pushing for the Lokpal bill in parliament, did not implement the Lokayukta Act in Uttarakhand which was brought in by the previous Bharatiya Janata Party government headed by BC Khanduri. Jairam Ramesh said Modi did not have a right to speak on the Lokpal bill, as he did not appoint a Lokayukta for 10 years in his own state. "A guy who didn't appoint a Lokayukta for 10 years is hardly the person to speak about Lokayukta. For 10 years, he didn't appoint a Lokayukta and he is giving 'updesh' (sermons) on Lokayukta. This is like Asaram talking about virginity," the union minister said at a press conference here. Asaram Bapu, charged with sexually assaulting a minor, is in judicial custody in Jodhpur since his arrest in September. Jairam Ramesh termed Uttarakhand's Lokayukta Act a "joke". The Uttarakhand Lokayukta Bill was passed unanimously by the state Assembly in November 2011. The act is yet to be implemented in Uttarakhand.

Pressure mounts on Justice Ganguly New
Delhi/Kolkata, December 16 In her affidavit to a three-judge panel set up by Chief Justice of India P Sathasivam to go into her allegation that Justice Ganguly sexually harassed her in a hotel room on December 24 last year, the intern has described in detail his alleged behaviour when she went to assist him in his work. Justice Ganguly, who has strongly denied the allegations and refused to step down as WBHRC chief, today raised questions on how a confidential statement can be made public. “That (the affidavit filed by the law intern) is supposed to be confidential as it was given to a Supreme Court committee. How can it come out in the open?” he said in Kolkata. “What can I do? Who is listening to me?” he said on being asked whether he would file a complaint on the issue. Jaising said she had made the excerpts public with the “full support” of the intern and if Justice Ganguly refused to resign, the process should be initiated for his removal by the President of India. She has written to Prime Minister Manmohan Singh in that regard. The ASG said she would like to state “very unambiguously that whatever I am doing, I am doing with her (intern’s) complete cooperation and keeping her in the loop and I would never ever make a document like this public unless I had her full support”. As pressure mounted on Justice Ganguly to resign, Law Minister Kapil Sibal said he was waiting to see when the apex court “rises to the occasion” to deal with the issue. “Waiting to see when and how the Supreme Court rises to the occasion to deal with Justice Ganguly,” Sibal tweeted. — PTI How can affidavit be made public? New Delhi, December 16 A Bench comprising Justices CK Prasad and Kurian Joseph passed the order after counsel representing the states told the court that their clients had framed issues to enable the court to adjudicate the original suit filed by Haryana in 2009. The Bench, however, advised the parties to make further efforts to identify common issues so that the court would be left with only contentious points for resolution. Granting time for this purpose, the Bench listed the next hearing for the third week of January 2014. Haryana has framed as many as 10 issues for adjudication by the SC, followed by Punjab and Jammu and Kashmir (eight each), Himachal Pradesh (two) and BBMB (one). Additional Solicitor General Mohan Jain had informed the court that the Centre would take a neutral stand on the issue and just ensure implementation of the SC verdict. The main point on which Haryana has sought SC ruling is whether it has a legal right to be associated with all the projects for generating power, constructed or to be constructed, on river Ravi and receive its proportionate share of power therefrom. Questioning the maintainability of Haryana’s suit under Article 131 of the Constitution, Punjab has maintained that it has the exclusive legal right to undertake any project in its territory for producing hydro power by non-consumptive use of water. “Whether Haryana has at all any legal right to a share in the power generated from the Anandpur Sahib Hydel Project, Thein Dam Project, UBDC Stage-II and Shahpur Kandi Hydel Scheme,” it wants to know. Being a statutory body, BBMB has questioned the logic behind making it a party to the suit. Among other things, Jammu and Kashmir wants a ruling as to whether the Punjab Termination of Agreements Act 2004 “can come in the way of its entitlement” under the Inter-State Conference of January 29, 1955. SC seeks Law Commission’s views on debarring candidates
New Delhi, December 16 A Bench comprising Justices RM Lodha and SK Singh said the Election Commission (EC) had submitted a note on electoral reforms, suggesting that the candidates against whom charge sheets were filed or charges were framed by the trial court six months prior to any election, should not be allowed to enter the
poll fray. Further, under Section 125 (A) of the Representation of the People Act (RPA), the EC was in a position only to file criminal cases against the candidates filing false affidavits. The EC should be empowered to disqualify such candidates. Acknowledging that the LC would require some time to submit a comprehensive report on all issues relating to electoral reforms referred to it by the government in January 2013, the Supreme Court asked the Law Commission to give its views immediately at least on two aspects - whether disqualification should be triggered upon conviction as it exists today or upon framing of charges by the trial court or filing of the charge sheet? And, whether filing of false affidavits under Section 125 (A) of the RPA should be a ground for disqualification? If yes, what should be the mode and mechanism for such a disqualification? The Bench passed the order while hearing a PIL filed by the Public Interest Foundation on the issue. It slated the next hearing for the second week of March 2014. The Bench has pointed out that everyone was interested in minimising the influence of “muscle and money” power in elections to enable parliamentary democracy function properly. SC allows Rajasthan Judge’s daughter to marry by choice
New Delhi, December 16 The Rajasthan Police produced Supriya in the court today in the light of an order passed by the SC on a habeas corpus petition filed by Mukherjee, contending that her parents had kept her under house arrest in Jaipur to prevent her from marrying Mukherjee, as he belonged to a different caste. At the outset, the Bench assured Supriya that “we will protect you at any cost” and asked her to make a statement on the issue. She said she did not have any ill-will against anyone, including her father Justice Raghvendra Singh Rathore, and she only wanted to marry Mukherjee. The Bench said that normally it would have asked her to approach the Rajasthan HC, but it had entertained the petition in view of the possibility that she “may not get proper relief” as her father was a sitting HC judge. New Delhi, December 16 The apex court will tomorrow hear the plea of the author who also sought scrapping of controversial section 66 (A) of the Information Technology Act which provides for arrest of a person hurting the sentiments of others through offensive remarks or information through electronic media, including social networking sites. Nasreen said she feared it will be "misused" against her. The petition was mentioned by senior advocate K K Venugopal before a bench of Chief Justice P Sathasivam and Justice Ranjan Gogoi which agreed to hear it tomorrow. The author, who was irked over the meeting of Aam Aadmi Party convenor Arvind Kejriwal with Muslim cleric Maulana Tauqeer Raza Khan, had posted some comments on her twitter account. A news report of a vernacular daily, based on her twitter posts, formed basis of the FIR lodged by Khan at Kotwali police station at Barelly under section 295A (maliciously insulting the religious beliefs) of the IPC and under section 66A of the IT Act. SC rejects plea for privatising defence canteens
New Delhi, December 16 A Bench comprising Justices HL Dattu and C Nagappan allayed the petitioner’s apprehensions over possible misuse of the profit earned by the Canteen Stores Department , stating the Defence Ministry was there to take care of that aspect. Petitioner Arvind Kumar Shukla contended that involving Army personnel in running the CSD amounted to misuse of their services, meant for defending the country’s borders. Already about 6,500 private persons were involved in running the CSD and as such there was nothing wrong in handing over the canteen operations to the private sector. The Bench, however, said Army personnel were possibly working in the CSD on rotation and that would not disrupt the vigil on the borders. It also did not agree with the contention that the Canteen Stores Department was acting above the government without accounting for the profit. The petitioner also cited the reports of the Comptroller and Auditor General (CAG) in support of his plea for privatisation, but the SC was not convinced. “We decline to entertain the petition,” the Bench said. |

63 Cavalry celebrates 1971 victory
New Delhi, December 16 The regiment has the distinction of earning battle honour of ‘Bogra’ and Theatre Honour ‘East Pakistan’ in 1971. The regiment with its five-pronged attack was referred by the Pakistanis as the “Ghost Regiment”. The regiment celebrated the event at Khasa, Amritsar. A “Tresath Seema Sampark Motor Cycle Rally” was also flagged in by Lieutenant Colonel (Retired) KG Jalnawala, the senior-most veteran of the regiment. The team of four riders led by Lieutenant Lionel Joseph Wilkins was flagged off from North-Sikkim by the GoC 33 Corps Lt Gen KJ Singh, who is also the Colonel of the regiment. The riders covered a distance of 2,795 kilometers. A sound and light show showcasing the journey of the regiment its raising in January 1957 in Alwar and important events along the journey. Some of the veterans, such as Lt General SS Mehta (retd), who was the leader of the Tank troop that first entered Dhaka, were also present. |

Sources said India was not prepared to take the issue lightly and would continue to raise it forcefully with Washington. New Delhi is also peeved that the diplomat was handcuffed and arrested in front of children only a day after Foreign Secretary Sujatha Singh had concluded her visit to Washington for foreign office level consultations. Sujatha's talks with her American interlocutors had gone off very well but the incident involving the Indian diplomat immediately thereafter is being considered humiliating by Foreign Office mandarins. ''We will take up the issue bilaterally...you cannot humiliate a young mother of two small children publicly,'' sources added. Thirtynine-year-old Khobragade, a 1999-batch IFS officer, was taken into custody on a street in New York while she was dropping her daughter to school and handcuffed in public on visa fraud charges. |

Mumbai, December 16 Hazare, who is sitting on fast at Ralegan Siddhi in Maharashtra's Ahmednagar district, has lost 4.3 kg, said doctors. A team of experts from Pune who are monitoring Hazare's condition advised him to take glucose water but Hazare refused. The activist's associates said a makeshift ICU equipped with an ECG Machine, ventilator and other equipment have been installed at Hazare's one-room accommodation in the village. Hazare says he will not give up his fast until the Rajya Sabha passes the Lokpal bill. The bill which was passed by the Lok Sabha earlier has been hanging fire in the upper house of parliament. |
Fog disrupts rail, air services in North
New Delhi, December 16 Also, over a dozen trains were rescheduled because of the late arrival of trains coming to the national capital. Services were partially affected in the northern states as poor visibility led to the slowing down of train movement. The delays led to rescheduling of 16 trains this evening which included the Howrah, Sealdah and Bhubaneswar Rajdhani express trains, a Northern Railway spokesperson said. Railways had earlier announced cancellation of some trains like the previous years to efficiently tackle train movement during foggy weather conditions. Schedules of around 130 domestic and international flights were delayed from half-an-hour to three hours. Nine flights had to be diverted to Jaipur, Ahmedabad and Lucknow as visibility at the runway dipped below 50 metres, the minimum required for a CAT-III B compliant plane to land using the instrument landing system (ILS). Fog started to envelop the airport soon after midnight but it thickened around 6.30 AM. The general visibility was almost zero while the runway visibility dipped below 50 metres, an airport official said. Nine flights, including an international flight from Amman, scheduled to land between 7 AM and 9 AM at Delhi airport had to be diverted. Poor visibility prevailed between 7 AM and 9.30 AM flight and no planes could either take-off or land at the airport, airport sources said. "Six flights were diverted to Jaipur, two to Ahmedabad and one to Lucknow. Before being diverted the air traffic control asked them to hover over Delhi for a while but as the planes were running out of fuel, they were asked to divert to these airports," they said. The two runways, main (28/10) and third (29/11) of Delhi airport are equipped with CAT-III B ILS, which allows a compliant aircraft to land even when the runway visibility was upto 50 metres. As soon as visibility increased above 50 metres after 9.20 AM, flights scheduled to land at Delhi airport were asked to land on the main runway (28/11), using CAT-III B ILS, as the visibility on the third runway was still poor. "But no flights were allowed to depart as the minimum visibility was around 125 metres and 150 metres, depending upon the size of the aircraft," the airport sources said, adding during most part of the morning, runway 29/11, remained closed. Take-offs started around 9.30 AM from main runway, after the runway visibility improved to above 125 metres. As the visibility improved, the airport officials faced huge backlog of flights. To avoid schedules going haywires due to fog, airport operator DIAL has this year introduced Delhi Airport Collaborative Decision Making (DA-CDM). The DA-CDM focuses on improving the air traffic flow and capacity management at airports by reducing delays, improving the predictability of events and optimising the utilisation of resources. Airport operators, airlines, ground handlers and air traffic control (ATC) collaborate and share data through automated system to increase overall airport efficiency, to reduce delays and congestion, and smooth flow of flight information to passengers. But passengers at the airport terminals complained about having little information about their flights.

Lucknow, December 16 Speaking to mediapersons during an interaction at his residence on the state’s development agenda, Yadav appeared awkward when it was pointed out that during the run-up to the Assembly election, he had ensured that another mafia don-turned-politicians DP Yadav was denied entry into the Samajwadi Party. “No one is above the law. Those who break it would have to face disciplinary action,” said Yadav while admitting that he had already received photographs of Ahmad’s display of arms. Ahmad arrived in his constituency yesterday in a cavalcade of 200 luxury vehicles with his supporters displaying sophisticated rifles, revolvers and pistols. Speaking to his supporters at the party office, he reportedly said he had more cases pending against him than the age of all the other aspirants put together. Responding to another question about children dying of cold in the Muzaffarnagar relief camps, Yadav said he respected the apex court’s strictures and had ensured adequate warm clothing was made available to the inmates in the relief camps. He said a large number of the inhabitants had left the camps but for some reason a number of them had once again returned to the camps. Earlier, the principal secretaries of four departments made presentations on the development agenda of their respective departments. Principal Secretary Power Sanjay Aggarwal said agreements had been made to arrange 13,000 MW additional power in the next three years so that 24 hour supply could be ensured in big and district towns and 16 hours in the rural areas. An ambitious project to ensure the maintenance of the 2 lakh km of rural roads was one of the thrust areas of the PWD department, said principal secretary Rajneesh Dubey. At least 500 additional MBBS seats had been added and three new medical colleges at Kannauj, Azamgarh and Jalaun started and new ones were to come up at Badaun and Banda from the next academic year, said principal secretary medical education J P Sharma. The Delhi-Mumbai Industrial Corridor was expected to attract investments to the tune of Rs 42,000 crore. Similarly, UP would be the major beneficiary of the Eastern Dedicated Freight Corridor from Amritsar to Kolkata as 57 per cent of the corridor passed through the state, said principal secretary infrastructure and industrial development S P Singh. |

New Delhi, December 16 Ironically, India’s globally competing neighbour China has frosty ties and disputes with Japan and also with some of the 20 nations that will send their navies to India in the first week of February 2014. The Japanese Naval forces called the Japan Maritime Self-Defense Force (JMSDF) would be here at the end of this month as part of the ‘Japan India Maritime Exercise’ - JIMEX, sources said. The Japanese will bring along three of their warships and India would have the same number. The first such exercise was held in 2012 and the second comes just months after Prime Minister Manmohan Singh and his Japanese counterpart Shinzo Abe had announced in Tokyo in May that sea-based forces of the two countries would conduct joint exercises on “regular basis with increased frequency”. India and Japan already have a bilateral maritime affairs dialogue, the first meeting of which was held in January this year in New Delhi. Announcements made by the two Prime Ministers have made Beijing react rather sharply. The country’s ruling Communist Party-run newspaper the ‘Global Times’, wrote an article “India gets close to Japan at its own peril”. Another mouth-piece - ‘People’s Daily’ - termed the Japanese as “petty burglars”. And this ‘warning’ to India came less than two weeks after Chinese Premier Li Keqiang ended a three-day visit to India (May 19-21) amid promises of resolving the 167-year-old boundary dispute with India. The next step will be when India would play host to 20 nations as part of exercise Milan, a bi-annual event, closely watched by China. Some of the invitees like Vietnam, the Philippines and Malaysia have overlapping claims and disputes with China in hydrocarbon rich South China Sea. The Milan exercise that first started in 1995 as part of India’s “Look East” policy with just five countries participating in it has been growing as India expands its footprint eastwards. New Delhi needs to protect the sea lanes of communication that carry cargo-laden merchant ships and has assumed the role of the “net security provider” in the Indian Ocean. Trade between India and ASEAN (Association of South-East Asian Nations) countries is likely to reach $100 billion by 2015 and most of it will be through the sea route that passes through the Straits of Malacca. |

Uttarakhand rape case: 3 sent to judicial custody
Dehradun, December 16 The Uttarakhand police had arrested Ritu Kandiyal, Amit Garg and Shiny Mac yesterday. Kandiyal is the key link between the 26-year-old woman, Additional Secretary, Home, JP Joshi and Joint Secretary Suman Singh Valdiya, as she was the one who introduced the woman to both Joshi and Valdiya. Garg and Mac are two others who were allegedly involved in the preparation of the CD. Police sources claimed that Kandiyal during interrogation admitted that she had sought Rs 3 crore from Joshi in lieu of the CD. Meanwhile, the Uttarakhand government suspended Valdiya after he was arrested for allegedly conspiring to prepare a sleazy CD to defame Joshi.

ISRO cautions against forged social media profiles Bangalore, December 16 It is observed that a number of pages in the social media (Facebook and Twitter) are floated in the name of ISRO/ Department of Space/ Mangalyaan and others, which have no authenticity and ISRO does not take any responsibility for any content hosted on these pages, ISRO said in a release. It said such impersonation of the organisation is construed to be a serious offence and stern legal action against these pages/administrators of these pages is being initiated from ISRO/Department of Space to bring them to immediate closure. AAP to organise ‘broom yatra’ to counter Modi Ahmedabad, December 16 "The broom yatra will be launched on January 26. During the yatra, we will expose the Gujarat government's corrupt practices. We aim to clean the political filth in the state," member of AAP national executive committee, Dinesh Vaghela said. The decision to organise the yatra was taken during AAP's two-day state executive meet, which ended here yesterday. ‘Bigg Boss’ contestant Armaan Kohli arrested Mumbai, December 16 Kohli was picked up from the Bigg Boss house by Lonavala city police in connection with the complaint registered against him by Hayat, the police said. On December 11, Hayat, who was recently evicted from 'Bigg Boss 7', had filed an FIR against Kohli at Santacruz police station here alleging that she was manhandled and subjected to unparliamentary language by him inside the 'Bigg Boss' house. "Following the complaint by Hayat, an FIR was registered against co-contestant Armaan Kohli," Arun Chavan, Senior Inspector at Santacruz police station, said. The Santacruz Police, after registering a case, transferred the complaint to their counterparts in Lonavala in Pune district, who conducted further probe into the matter. Kohli has been booked under Sections 324 (voluntarily causing hurt by dangerous weapons), 504 (intentional insult to provoke breach of peace) and 509 (word, gesture or act intended to outrage the modesty of a woman) 506 (criminal intimidation) and 354-A (sexual harassment) of the IPC. — PTI |
