Punish Akali MLA for hoarding liquor, Khaira urges EC
Tribune News Service

Chandigarh, May 7
The Punjab Congress today urged the State Election Commission to take stern action against SAD MLA from Faridkot Deep Malhotra for allegedly hoarding two lakh boxes of liquor in Ludhiana for distribution among voters during the forthcoming panchayat samiti and zila parishad elections.

In a statement here, Congress spokesman Sukhpal Singh Khaira alleged the Excise Department had recovered two lakh boxes from the Ludhiana godown of Malhotra’s firm Gaurav Malhotra and Company but had succumbed to pressure and seized only 70,000 of them. He claimed though the godown was raided on May 3, the officials reported the seizure three days later on May 6.

Khaira claimed the Congress had “reliable information that the stock was meant for distribution amongst the electorate”. “Similar hoarding has been planned by Akali leaders at other district headquarters,” he said.

The Congress leader urged the Election Commission to launch criminal proceedings against the MLA and also demanded that the licence of his liquor firm be cancelled.

SAD to meet President on Sajjan’s acquittal today
Tribune News Service

Bathinda, May 7
Deputy Chief Minister Sukhbir Badal today said they would impress upon President Pranab Mukherjee to form a special investigation team (SIT) to re-investigate the role of Congress leader Sajjan Kumar, acquitted recently in a 1984 anti-Sikh riots case.

Chief Minister Parkash Singh Badal and his deputy Sukhbir Badal would be leading a delegation of SAD-BJP coalition MLAs and MPs to meet the President in Delhi tomorrow.

“Surely someone was behind the attack that killed over 3,000 Sikhs in the capital. For, Delhi was not hit by any calamity,” Sukhbir said in a sarcastic remark targeted at the Congress.

“Nevertheless, we will fight for justice till it is done. We will seek the President’s intervention for forming a SIT under the supervision of the Chief Justice of India,” he said. The Deputy Chief Minister was here to attend the 290th birth anniversary function of Maharaja Jassa Singh Ramgarhia. While paying tributes to the legendary warrior, he assured the Ramgarhia community that the government was committed for its welfare.

“We should propagate the legacy of Ramgarhia who fought the Mughals valiantly to safeguard the moral and ethical values of humanity based on the tenets of Sikhism,” he said.

Hitting out at the UPA government, he alleged that in the country’s history never had the central cabinet comprised so many “tainted” ministers.

Sukhbir also dared the Congress leadership to put up a fight so that it was not against a “one-sided affair in the zila parishad and block samiti elections”.

“In fact, it will be a litmus test for (Punjab Congress chief) Partap Bajwa and test his political acumen and popularity at the grassroots level,” he said.

Rights group to move SC; seek SIT on 1984 riots
Sanjeev Singh Bariana
Tribune News Service

Chandigarh, May 7
Claiming that Congress men Jagdish Tytler and Sajjan Kumar were “just two among hundreds who participated in the massacre of Sikhs after the assassination of the then Prime Minister Indira Gandhi in 1984, Lawyers for Human Rights International, today announced its decision to move the Supreme Court seeking the formation of a Special Investigating Team (SIT), as had been done in the Gujarat riots cases, to probe the Sikh riots and "reopen cases buried by successive governments”.

Addressing a press conference here today, Navkiran Singh, general secretary of the group, produced data on the killings. He said the conviction rate had been negligible.

“Records show that at least 90 Sikhs were killed on Delhi's platforms. Only seven cases were registered and all the cases were sent to court as untraced,” he said.

Navkiran Singh said of the total cases registered, more than 40 per cent had remained untraced because of improper investigations. Of the 1,492 cases registered, only 580 were sent for trial and 660 remained untraced. Of the total 580 cases sent for trial, conviction could be secured in only 40 cases.

He said: “We have decided to move the Supreme Court with the data and request it to constitute a SIT to ensure fair and free investigation”.

He said Sajjan Kumar's acquittal in a riots case showed that he enjoyed political patronage. He claimed that the states of Uttar Pradesh, Madhya Pradesh, Himachal Pradesh, Jammu and Kashmir and Maharashtra had not provided the group the data sought under the RTI.

He showed a Ministry of Home letter dated February 2008 which stated that 2,733 Sikhs had been killed in Delhi while information under the RTI put the figure at 1,605.

SC to hear petition seeking stay on Bhullar’s execution
R Sedhuraman/Legal Correspondent

Devinder Pal Singh Bhullar New Delhi, May 7
The Supreme Court today agreed to consider a PIL filed by Navneet Kaur, wife of death row convict Devinder Pal Singh Bhullar, pleading for a stay on his execution, pending the disposal of petitions seeking a review of the April 12, 2013, Supreme Court judgement refusing to show him mercy.

Appearing before a three-Judge Bench comprising Chief Justice Altamas Kabir, Justice Vikramajit Sen and Justice Kurian Joseph, Navneet Kaur’s senior counsel Ram Jethmalani pleaded for an early hearing of the PIL. Jethmalani said Navneet Kaur had filed the PIL, apprehending execution of her husband despite the review petitions filed by her and Bhullar. The Bench questioned the logic behind the petition, pointing out that the Supreme Court had already rejected Bhullar’s review petition on December 17, 2002, and curative petition on March 12, 2003, against the March 22, 2002 judgement upholding the death sentence. Nevertheless, the Bench said it would consider the plea for a stay. The Supreme Court, in its April 2013 ruling on petitions filed by Bhullar and his wife seeking that Bhullar’s death sentence be commuted to that of life term had said that terrorists had no right to seek mercy citing official delays and other reasons.

The anti-terror court which had held the trial in Delhi had awarded the death sentence on August 25, 2001 “simply on the basis of his alleged confession recorded by a Deputy Commissioner of Police during police remand” as the police had “miserably failed to prove its case beyond reasonable doubt and failed to produce any reliable witnesses,” Navneet Kaur pleaded in her PIL.

The PIL questioned the legality of the May 30, 2011, Presidential order rejecting Bhullar’s mercy plea, pointing out that the file sent to Rashtrapati Bhavan in 2005 and 2011 did not contain the fact that Justice MB Shah, presiding Judge of the SC Bench which had heard his appeal, had given a dissenting verdict, acquitting him for want of proof.

In Abohar, Akali Dal fields woman Bishnoi candidate
Raj Sadosh

Abohar, May 7
The SAD has, for the first time, fielded a woman candidate of the Bishnoi community for the Zila Parishad (ZP) elections in the Balluana (Abohar) segment.

Raj Laxmi is the sister of SAD youth wing district president Sanjeev Godara. Another SAD candidate Prahlad Kumar Neol, former chairman, Improvement Trust, and his wife contesting the Abohar Panchayat Samiti elections also belong to the Bishnoi community that has a population of 25 thousand in the area.

Balluana MLA Gurtej Singh Ghuriana and former MLA Parkash Singh Bhatti, who joined the SAD after losing the last Vidhan Sabha elections, have closed ranks. Hundreds of Congress workers led by Congress Legislature Party Leader Sunil Jakhar thronged the sub- divisional complex on the last day of filing of nomination papers. The Congress expects a smooth-sailing owing to a triangular contest. Despite warning by the high command, councillors Vijay Nagpal and Gurlal Singh Danewalia of the SAD and other party workers escorted a group of Independents who filed their nomination papers.

These councillors had reportedly backed liquor baron Shiv Lal Doda during the assembly elections. Doda, a member of the BJP business wing national committee, had campaigned for SAD candidate Jatinder Pal Jain in the Moga byelection. Now, he has fielded Independent candidates in all the zones.

The Social Welfare Board chairperson, Vijay Laxmi Bhadoo (BJP), has played an important role in finalising the party candidates in the Khuyiansarwar segment. Bhadoo, state BJP secretary Sandeep Rinwa, district president Sita Ram Sharma and former MLA Dr Ram Kumar Goyal accompanied the alliance candidates to the SDM's office for filing the nomination papers.

Congress workers allege harassment
Aman Sood/TNS

Patiala, May 7
Even though the Election Commission is committed to free and fair panchayat samiti and zila parishad elections, the practice of serving liquor to garner votes remains uncurbed.

The sale of liquor on May 19 (polling day) has been banned. The state Election Commission has issued strict instructions to ensure that liquor is not served to voters on the sly.

“Since 60 per cent of the liquor trade in the state is owned and run by politicians and their aides, we cannot claim to put a complete stop to the menace. But surely we will keep a close watch,” he said.

Meanwhile, the Congress says the police and the administration are building pressure only on Congress supporters.

“We have received numerous complaints from our supporters who say the official machinery is being used to harass them,” said Congress MLA from Sanaur Laal Singh.

An excise official said the department would spare nobody. Cabinet Minister SS Rakhra claimed the Congress was trying to make an issue of nothing.

Fatehjung: CM misled House on memorial
Tribune News Service

Chandigarh, May 7
Punjab Congress general secretary Fatehjung Singh Bajwa today accused Punjab Chief Minister Parkash Singh Badal of misleading the Vidhan Sabha on the ‘marteys’ memorial’ in the Golden Temple complex in Amritsar.

He asked the Chief Minister to stand by his statement on the floor of House that the memorial would be a simple gurdwara and no pictures would be displayed there. He said the Congress was keeping an eye on the developments pertaining to the memorial and if need be would approach the Centre for appropriate steps.

Bajwa said the Congress was worried over the deteriorating law and order situation and nobody would be allowed to disturb peace in the state. He said that Congress was aware of the consequences of eulogising separatist elements.

The Congress leader said the controversy over the memorial had exposed the SAD’s double standards. He alleged that Badal had “misguided” the youth in the early 80s and pushed Punjab into a turmoil. Now that the SAD-BJP Government had failed on all fronts, it was diverting people’s attention by building an atmosphere of confrontation and encouraging radical elements, he alleged.

Theatres loath to screen Sadda Haq
Gagan K. Teja
Tribune News Service

Patiala, May 7
The miseries of the producers of controversial Punjabi film ‘Sadda Haq’ appear to be unending. After fighting a long legal battle for its release in Punjab, the movie again faces uncertainty as several single-screen and private theatre owners in several districts have allegedly refused to screen it. The move, the producers alleged, had come under pressure from the local administration and the Police Department.

In a fix over the latest problem, the film’s producers, Kuljinder Singh Sidhu and Dinesh Sood, have blamed the local administrations of a few cities for allegedly threatening cinema owners against screening the movie.

The producers said though multiplexes had tied up with them for the movie’s release, theatre owners in Patiala, Ropar, Ludhiana and Nawanshahr were showing reluctance.

“They do not want to mess up with the powers that be because of one movie. Therefore, they have politely conveyed it to us that they are helpless,” they said.

Sidhu, who plays the lead role, said: “I am disappointed at the turn of events. Bollywood has also made several movies on similar lines in the past. Why is so much fuss only about Sadda Haq?” he asked.

The district administration and theatre owners in Patiala, however, have refuted the allegations. Patiala Deputy Commissioner GK Singh said no one from the district administration had spoken to the movie’s team or theatre owners. “The allegations are baseless and if at all someone has tried to threaten them, they should come out with the details and we will take action against the guilty,” he added.

A theatre owner, Harjinder Singh, said they were not running the movie only because they had already tied up with distributors of other films.

At last, pension for freedom fighter from Patran
Saurabh Malik/TNS

Chandigarh, May 7
Nearly 70 years after Sohan Singh remained in jail for participating in Quit India Movement, the 100-year-old freedom fighter from Patran in Patiala will finally get pension. A Division Bench of the Punjab and Haryana High Court has dismissed an appeal filed by the Centre against the grant of pension.

In his petition filed before a Single Judge through counsel Rajeev Anand, Sohan Singh had earlier claimed that he was entitled to freedom fighters' pension in accordance with the Swatantrata Sainik Samman Pension Scheme, 1980, since he was imprisoned in the Multan Central Jail after he participated in Bhai Pheru Morcha in 1924-25. He had claimed that a fine of Rs 200 was imposed on him under the orders of Camp Court at Bhai Pheru. Sohan Singh was put behind bars again from October 20, 1942, to November 19, 1943, in the Lahore jail for participating in Quit India Movement and fined Rs 150.

The Centre had turned down the claim on the ground that there was discrepancy in the dates mentioned in the application forms. In one of the applications, Sohan Singh had claimed that he was in prison in 1924-25 and in another that he was behind bars in 1942-43.

Directing the Centre to disburse the pension, the Single Judge asserted that the number of freedom fighters was dwindling by the day and even hearsay evidence for participation in the freedom movement ought to be permitted. Feeling aggrieved, the Union of India preferred appeal.

Taking up the matter, the Bench of Justice Surya Kant and Justice RP Nagrath directed the Centre to find out through the Indian Embassy in Pakistan whether Sohan Singh had been imprisoned in the Lahore Central Jail in 1942-43. As the Centre could not secure a report, the Bench directed Punjab “to hold a fresh fact-finding inquiry into the claim”. After interacting with prominent persons, a sub-divisional magistrate concluded that “he was recognised by everyone as a freedom fighter who remained in prison before Independence”.

The Bench asserted: “After going through the statements and the report, we are satisfied that the claim propounded by Sohan Singh that he is a bona fide freedom fighter who participated in Quit India Movement in 1942-43, is true and correct. “The discrepancies referred to by Union of India deserve to be overlooked keeping in view the old age of Sohan Singh…. The appellants shall do the needful within two months….”

Authorities accept all demands but one
Sushil Goyal
Tribune News Service

Sangrur, May 7
The impasse between the agitating students of Sant Longowal Institute of Engineering and Technology (SLIET) and the authorities continued here on campus as students persisted that SLIET Director Sunil Pandey should be removed.

Hundreds of sloganeering students have been protesting near Pandey’s residence since Monday.

The students went on the rampage yesterday demanding that students shouldn’t be fined for missing lectures and that it shouldn’t be compulsory for them to attend 100 per cent lectures.

They also demanded that they pay for the days they eat at the mess, as opposed to paying a monthly bill. They had set the auditorium on fire and pelted stones at the buildings.

Even though Sangrur Deputy Commissioner (DC) Kumar Rahul, who is mediating between the campus authorities and the students, met the latter today and accepted their demands, the students persisted with their demand that the director be removed.

The Deputy Commissioner then reportedly returned to the SLIET guest house where he along with Senior Superintendent of Police (SSP) Mandip Singh Sidhu and other senior officers have been camping to keep a close vigil on the situation.

The administration had deployed over 400 police personnel yesterday to control the situation.

Meanwhile, Punjab Finance Minister Parminder Singh Dhindsa today also visited the campus and directed the officers to accept the demands of the students.

Rahul said, “Since we have redressed all the grievances of the students, they should lift the dharna and talk to us to resolve the issue.”

HC tells pharma body to specify drug prices
Tribune News Service

Chandigarh, May 7
The Punjab and Haryana High Court today directed the National Pharmaceutical Pricing Authority (NAPA) to ensure that medicine manufacturers print “not under price control”, if the value is not controlled by the government.

The directions came during the resumed hearing of a PIL based on suo motu cognisance of a letter to the Chief Justice from Faridkot-based Bhai Ghanaiya Cancer Roko Seva Society.

As the case came up for resumed hearing, amicus curiae or friend of the court HC Arora asked the court to issue the direction to NAPA to ensure compliance of Drugs (Prices Control) Order, 1995. Referring to the order, Arora asserted manufacturer, importer or distributor of a non-scheduled formulation which was not under government price control was required to display “not under price control” on a green strip.

The amicus pleaded that awareness could be generated among consumers by ensuring implementation of the provisions. Accepting the prayer, the Division Bench of Acting Chief Justice Jasbir Singh and Justice Rakesh Kumar Jain directed NAPA to ensure that manufacturers complied with the provisions.

Taking suo motu cognisance of a letter seeking action against renowned pharmaceutical companies for looting cancer patients by printing inflated maximum retail price on the medicines, the High Court had earlier put the Punjab Government on notice.

In its letter dated February 2, the society had informed the Chief Justice that Guru Gobind Singh Medical Hospital, Faridkot, purchased medicines directly from pharmaceutical companies at MRP of Rs 19,800 whereas the original cost price of the medicine was Rs 1,738.

Sachin Gupta (18), who was reported to have been kidnapped on the night of May 4 from his house in Basant Avenue near BCM School, Dugri, was today found murdered. His body was recovered from the storeroom of a house in the neighbourhood.

The police has arrested Gabbar Singh alias Chhotu (20) from Uttar Pradesh working as a domestic help in Manjeet Singh’s house located opposite that of the victim’s.

Chhotu reportedly confessed to have killed Sachin and dumped the body in the storeroom. The police has recovered a baseball bat used in the crime. It does not rule out Manjeet Singh and his son Davinder Singh’s involvement in the killing.

As foul smell began to emanate from Manjeet Singh’s house, area residents approached policemen camping outside Sachin's house who immediately cordoned the area.

Chhotu, who was being interrogated, broke down. He told the police that he had dumped the body in the storeroom. “The accused covered the body with rags. He placed a trunk on the body and a bed over it,” said Deputy Commissioner of Police (DCP) Harsh Bansal.

The police suspects that a monetary dispute may have led to the killing.

ACP (Gill) Gurpreet Singh Sikand said: “Chhotu told us that Sachin had borrowed Rs 1,200 from him. Instead of returning the money, Sachin would abuse him. On May 4, Chhotu engaged Sachin in a conversation and took him to a storeroom in Manjeet Singh’s house where he killed him with a baseball bat.” Manjeet Singh claimed he was innocent and that he resided on the first floor and had no clue about the incident. However, the victim’s family remained unconvinced.

Killer posed as kidnapper

Chhotu told the police that the victim’s mother, Ranju, kept calling on her son’s cell phone. He attended one of the calls. Pretending to be a kidnapper, he demanded Rs 50 lakh for Sachin’s release. He said he did so to mislead the family and the police. He later threw the phone in a nearby plot. The police has recovered the cell phone. Chhotu also told the police that he did not flee so as not to raise suspicion and carefully followed the police investigation. He planned to dump the body somewhere else at the “right time”.

Family, friends pelt stones

Sachin’s relatives and friends threw stones at Manjeet Singh’s house. Manjeet Singh, his wife, daughter-in-law and son sustained minor injures. Heavy police was deployed in the area and Manjeet Singh’s family taken to the police station for questioning. The crowd tried to set the house on fire.

Kin doubt police theory

Friends and relatives rubbished the police theory that monetary dispute had led to Sachin's murder. Sachn's friend Varun said: “He had two high-end cell phones and an expensive car. He would not have borrowed money from a servant.”
