Decision on Kanimozhi bail plea today

The Special CBI court hearing the bail plea of 2G Spectrum allocation scam accused DMK MP Kanimozhi deferred its decision till tomorrow. Appearing before the court of CBI Judge O P Saini today morning after being summoned, Kanimozhi’s defence was taken up by the former Union law minister Ram Jethmalani who contended that his client was a mere 20 per cent share holder of the Kaliangar TV and not responsible for the day-to-day running of the company and hence can not be held responsible for any “overt act committed by the company”.

“This woman has nothing to do with the spectrum”, said Jethmalani in his opening defence before taking a dig at CBI that as per the agency, Kanimozhi’s only offence is that she is a shareholder in the company that is being accused of accepting Rs.200 crores on loan. The seasoned lawyer than went into the details of allegations before countering them one by one. “The allegation is Swam Telecom paid a bribe to Kalaignar TV. Assuming for a moment that it was at Raja's instance that Swan paid Kalaignar TV, what is the offence committed here? Kanimozhi is just a shareholder in the company. Not even a majority shareholder. She just has a 20 per cent equity. It's only the Board of Directors who control the company and they alone can be held for criminal liability," argued Jethmalani while passing the buck to the Managing Director of Kalaignar TV, Sharad Kumar, also present in the court and seeking bail plea on the similar charges being faced by Kanimozhi. Kumar also owns 20% share in the channel. The 2G Spectrum case relates to irregularities in the allocation of airwaves to telecom operators that caused huge losses to the national exchequer.

Kanimozhi looked quite composed. She was accompained by her husband Arvindan and several DMK MP’s, including T R Baalu and A K Vijayan. Karim Morani of Cineyug Films who, too, was summoned by the court got an exemption as he is admitted to Mumbai's Lilavati Hospital. His bail application will be heard on Tuesday.
