Apart from questions being raised over a series of material procurements, including those from foreign vendors, during and after operations, a large number of instances have come to light where officers and field commanders, who had performed well in battle, have alleged that they were given a raw deal. Many such officers opted out of the service prematurely after being overlooked for promotion. The most notable case, now pending before the AFT, is that of Brigadier Surinder Singh, the then commander of the 121 (Independent) Brigade at Kargil. He was unceremoniously removed at the height of the conflict and later his services were terminated on charges of mishandling classified documents and not seeking proper permission for vacating the Bajrang post in the Kaksar sector under his jurisdiction. While blaming the military leadership for lapses that led to the conflict in which over 540 Army personnel, including many young officers, were killed, Brigadier Surinder Singh has claimed that he had personally briefed the then Army Chief, Gen VP Malik and the then Director General Military Operations, Lt Gen NC Vij (later Army Chief) about the enhanced threat perceptions in that area, including artillery and missile deployments, on the other side. There had been reports of infiltrations in the south of Siachen Glacier as early as January and February 1999 which were conveyed to the top leadership, he said. Another officer, Col Nehra, who was the Commanding Officer of 22 Grenadiers, too, had moved the Bombay High Court against adverse remarks in his annual confidential report. A junior officer, Maj Manish Bhatnagar, who was dismissed by a General Court Martial for professional impropriety has moved the AFT challenging his court martial and seeking an independent inquiry into the whole episode. While the case pertaining to his court martial will come up for hearing in July, the AFT had dismissed his plea for inquiry on the grounds that it does not have the jurisdiction over the matter. He said that he is now contemplating approaching the High Court or the Supreme Court. ‘Disillusioned ‘over not being promoted despite showing good results during the operation, Col Lalit Rai, who had commanded 1/11 Gorkha Rifles and was decorated with the Vir Chakra, opted for premature retirement. Of the 17 infantry battalions awarded Battle Honours and Honour Tittles for exceptional performance during the conflict, the commanding officers of most of these units have opted for premature retirement, as they had been overlooked for promotion. Col OP Yadav, who commanded 1 Bihar and Col JS Bawa, of 17 Jat, were approved for promotion in review boards in 2007. CO 18 Grenadiers, Col K Thakur picked up his rank a year later. Of the main three brigades in the centre of operations --- 192, 70 and 56 — the commander of just one was promoted. The figures imply that the Army found less than 20 per cent of commanders who did well in battle fit for promotion. Commanding officers of a number of other units who performed e have also been superseded. On the other hand, all generals associated with the planning and conduct of operations, either at Army Headquarters or formation HQs, walked away with one award or the other. Among the seven Brigade commanders involved in operations, four moved up the ladder. After Brig Surinder Singh was moved out, his successor, OP Nandrajog who took over at the fag-end of the conflict, later became GOC-in-C Central Command, while Commander 102 Brigade in Sub-Sector Haneef, PC Katoch became a Lieutenant General. Then Commander of the Para Brigade, P. Bhardwaj is presently the Army’s Vice Chief. Noticeably, none of the battalions under their command got a Battle Honour. Along Dras-Mushkoh, 79 Brigade commander, RN Kakar, tasked with capturing Point 4875 became Major-General, while Brig Amar Aul, commander of 56 Brigade that captured Tololing, become Lieutenant General. Three and two units under their respective command got battle honours. Commander 192 Brigade, MPS Bajwa, who captured Tiger Hill, perhaps the most celebrated feature of the conflict, retired on the same rank. |
Cong begins selection process

New Delhi, May 27 The seats falling vacant include those held by Union ministers Ambika Soni and Jairam Ramesh and Congress general secretaries BK Hariprasad, Mohsina Kidwai and Oscar Fernandes. The party also has to find a slot for Commerce Minister Anand Sharma, whose term expired on April 2. The Congress does not have the numbers to get him re-elected from his home state, Himachal Pradesh. Nehru-Gandhi family loyalist Satish Sharma also has to be accommodated as the party is in no position to win his seat in Uttarakhand. While Ambika Soni and Mohsina Kidwai are set to get another nomination from Punjab and Chhattisgarh, respectively, for Anand Sharma it is a toss up between Rajasthan and Maharashtra. The controversy-ridden Environment Minister Jairam Ramesh is expected to be renominated from Andhra Pradesh. Although leaders from Maharashtra and Andhra Pradesh have conveyed their unhappiness over the induction of “outsiders”, their protests may well be overlooked. Besides Ramesh, other members retiring from Andhra Pradesh include JD Seelam, V Hanumantha Rao Girish Sanghi and N Janardhana Reddy. The ruling party can comfortably win three seats but will have to muster support from its allies like the Majlis-e-Ittehadul Muslimeen, which has seven MLAs, to get the fourth. Of these, Seelam is likely to be renominated as he belongs to Scheduled Caste. Former minister Renuka Chaudhary and Andhra Pradesh Congress committee president D Srinivas are among those who are lobbying for a seat. Congress loyalist Oscar Fernandes is also all set for another term from Karnataka but the party does not have the numbers to ensure the re-election of its second retiring MP BK Hariprasad. It is negotiating with Deve Gowda’s Janata Dal (S) as the combined strength of their extra votes can get one seat. However, Gowda is acting tough and has announced the candidature of Danish Ali, hoping that the Congress will have no choice but to support a minority candidate. The Congress, on its part, has offered to help the JD (S) in the Karnataka legislative council in exchange for its support in the Rajya Sabha election. The Congress does not have the numbers to win a seat in Jharkhand, but the party president has given a green signal to the state unit to negotiate with other parties, including the JMM, for one seat. In Bihar, the Congress is inclined to pledge the support of its eight MLAs to former Union minister Ram Vilas Paswan, who is negotiating with Lalu Prasad Yadav’s RJD to notch up the requisite votes for a victory. |

Hyderabad, May 27 The couple had eloped from the village six months ago and returned recently in the hope of convincing their elders. Quoting eyewitnesses, the police said the girl’s relatives, who were enraged over their relationship, attacked and killed the duo.
Incidentally, Srinivas was already married with two children. However, his first wife had no objection to his second marriage with Swapna. “The girl’s relatives attacked the couple when they were sleeping outside their house at around 10.30 on Wednesday night. The couple was dragged on to the road and hit with boulders resulting in their instant death,” the Nizamabad district Superintendent of Police K Venkateshwara Rao said. Following the ghastly incident, the close relatives of Srinivas, who worked as a computer operator in a private firm in Hyderabad, fled the village fearing attacks. The police said it was not clear whether Swapna and Srinivas had entered into wedlock or were live-in partners. “Since their return to the village a week ago, the duo was staying together along with Srinivas's wife and children,” the SP said. As the honour killings, the first to be reported in the state, evoked a wide sense of public outrage, the police have arrested one person in connection with the case and a search was on to nab other attackers. A case of double murder has been registered and a post-mortem was conducted on the bodies of the couple at a hospital in Kamareddy town. A year ago, Swapna went missing from the village and the police had then registered a case following a complaint filed by her father. However, she returned to the village after three months and the complaint was withdrawn. Six months ago, she left the village along with Srinivas and returned recently only to meet a tragic end at the hands of her close relatives, the police said. |
Despite 26/11 taint, Gafoor likely to get top police post
Mumbai, May 27 The Ashok Chavan government responded to the leak by tabling the Action Taken Report instead of the entire Ram Pradhan Committee report in the state Assembly. As part of the face-saver, Gafoor was promoted to the rank of Director General of Police (anti-corruption bureau) and D Sivanandan was appointed as City Police Commissioner. Justifying Gafoor’s promotion as state’s top cop, Chavan says no strictures were passed against him. Gafoor, a 1974 batch officer, is the senior most DGP and the Maharashtra government has almost decided to go by seniority while making the new appointment when incumbent AN Roy retires on May 31. The Supreme Court had earlier ruled that appointments to the posts like the DGP should go by seniority alone since there is little difference in the calibre of two officers at that level. It also helps Gafoor that despite his presumed closeness to Chavan he maintained good relationships with the Nationalist Congress Party as well as the Congress. As per the power-sharing deal between the two parties, the Mumbai police chief is the NCP’s choice. The arrangement has split the police force into factions, with senior police officers being accused of openly planting stories against each other. Some of them even went further and actually testified against Gafoor on record during the hearings by the Pradhan panel. Some of the alleged remarks found their way to the media thereby making it difficult for the government to let Gafoor continue to be in Mumbai. |
SC: Judiciary cannot order re-evaluation

New Delhi, May 27
Allowing the appeal filed by the Himachal Pradesh Public Service Commission against the December 2006 judgment of the HC, a Bench comprising Justices BS Chauhan and Swatanter Kumar clarified that in the absence of any provision under the statute or statutory rules/regulations, the judiciary should not “generally direct revaluation” of answer sheets of candidates appearing for examinations meant for recruitments. The HC had ordered re-evaluation in case of a candidate, who had failed in a paper by one mark but had stood second, going by the aggregate marks of the aspirants for the posts of 13 Civil Judge (Junior Division). The exam results were declared on September 4, 2005. On a petition filed by him, the HC directed the commission to produce his answer sheets in the court. Holding that there was some “inconsistency” in framing two questions and in the evaluation, the HC directed the commission on October 5, 2005 to arrange for a special interview for the candidate. The HC further passed an order on November 22, 2005, directing re-evaluation of the paper by a reader in the Law Department of HP University, though the commission had argued that there was no provision for re-evaluation. Arguing for the commission in the SC, counsel Anil Nag had maintained that if there was some inconsistency in the questions/marking, it would have anyway affected all candidates and if at all there was a need for re-evaluation it should have been ordered for all. The Bench accepted the contention. “It was not permissible for the High Court to examine the question paper and answer sheets itself, particularly, when the commission had assessed the inter-se merit of the candidates…It was a matter of chance that the High Court was examining the answer sheets relating to law. Had it been other subjects like physics, chemistry and mathematics, we are unable to understand as to whether such a course could have been adopted by the High Court,” the SC said. Pending the outcome of the litigation, the candidate appeared in two subsequent selections but could not succeed and now he has become overaged as well, the Bench observed. “Even on any other ground, the respondent No. 1 cannot be offered appointment, it ruled. |
After a 3-week wait, Hooda meets Sonia
New Delhi, May 27 He was accompanied by AICC general secretary Prithviraj Chavan. The infamous incident of Dalit violence in the state had left the Congress president fuming. Once a blue-eyed boy of the party leadership, Hooda was sternly pulled up by Sonia for his administration’s handling of attack on Dalits by a Jat mob. In a letter to him she categorically told him that the incident was a matter of shame and horror. Hooda spoilt his case when he failed to visit the village immediately and rushed to meet families of victims only after he was told to do so by the Congress leadership. What proved that he had indeed fallen from the grace was when he was not taken into confidence for a visit to the village by AICC general secretary Rahul Gandhi to meet families of the victims of caste violence in which a 17-year-old polio-stricken girl and her father were burnt alive. Mirchpur was also in the eye of the storm at a recent meeting of Haryana coordination committee panel attended by Union Minister Kumari Selja, Chaudhary Birendra Singh, Ajay Singh Yadav and Rajya Sabha member Ram Prakash, in which Chavan is understood to have agreed that the incident had sent a negative signal about party regime and termed it a matter of concern. Apparently, a clear signal to Hooda, already in the doghouse for his patronage to the Jat-dominated khap panchayats in the state, is that he should pay heed to senior leaders in the coordination committee while taking policy decisions. Sources say the AICC wants major policy issues to be discussed by the seven-member committee headed by AICC general secretary in charge of the state Prithviraj Chavan before being taken up by the Cabinet. Instructions are that panel should meet every month and have a more structured agenda for discussion. Hooda has also been directed to hold a meeting of MPs along with state officials ahead of the every Parliament session to help MPs know about issues to be raised in the House regarding demands from the state. While he has been under fire from the High Command and for administrative lapses in preventing atrocities against Dalits in the state, Hooda is also facing the heat from his detractors, who also want a larger say in vital policy issues. They want issues like transfers and posting of bureaucrats to be vetted upon by the panel. In the previous two coordination committee meetings also, they wanted transfers and postings of IAS and IPS officers in the state to be cleared by the committee. |

Shoeshine boy shines in IIT exam
Kanpur, May 27 Abhishek, who secured 154th rank in the SC category of IIT entrance test, now wants to propel his dreams by pursuing aerospace engineering at IIT-Kanpur here. His father earns Rs 60-70 daily and mother stitches old clothings to earn money. But "this has never held them back from facilitating our education," Abhishek says, dedicating his success to his parents. Abhishek, who also tries to pitch in by polishing shoes at his father's shop, has three young brothers and the family of six lives in a one room accommodation with no electricity. "We have just one small room where six of us live and that too without electricity. So, he used to study under the lantern for five-six hours in the night," says his father Rajendra Prasad. The family could not even think of providing coaching to Abhishek. "But by God's grace, a teacher of a coaching institute helped him out," he says. But even in the time of happiness, poverty haunts the family. "I am worried about the fees. From where can I manage the amount? This question is troubling my mind but even if I have to sell myself, I am ready for it," Prasad told PTI. With relatives flocking their house after hearing the news, the joyous father says he has not been able to open his shop since the IIT-JEE result came out yesterday. "We are very happy. He is the first person in our family to be selected to the IITs," says his uncle Manoj Kumar.

Dalai inaugurates Buddha Smriti Park in Patna
Patna, May 27 The Dalai Lama was here to inaugurate the Buddha Smiriti Park on a 22-acre plot next to Patna junction worth Rs 125 crore. The Bihar Chief Minister had specially visited Dharamsala to invite the Dalai Lama for inaugurating this park on the occasion of Buddha Purnima. The Dalai Lama gifted some buddhist relics and a sapling of Mahabodhi tree brought from Sri Lanka that has been named by him as ‘Pataliputra Karuna Stupa’. Aftr the inaugural ceremony, the Dalai Lama told mediapersons that changes were taking place fast in China and the communist party was functioning without the communist ideology. He was hopeful about an amicable solution to the problems of Tibetans as the intelligentsia had started speaking and writing on the problems being faced by Tibetan refugees for the past 50 years. When asked, the septuagenarian leader of the Tibetan government in exile said Arunachal Pradesh was an integral part of India. By her own admission, her assets are multiplying at the rate of almost Rs 1 crore a month during one of the most recessive periods of the Indian economy! Most of her assets are in the form of commercial and residential properties in the upmarket areas of New Delhi and Lucknow. She owns five sprawling commercial properties and bungalows at prime locations in New Delhi, Okhla and Lucknow. The property at No. 3, Block B, Connaught Place, measuring 3628.02 square feet, is valued at Rs 2.05 crore, while B-34, I floor, Connaught Place, measuring 4535.02 sq.ft is rated at Rs. 1.27 crore. Her commercial property at No.1, Community Centre, Okhla, Phase I, New Delhi, measuring 34,112.26 sq ft, is valued at Rs 15.50 crore. Her house in New Delhi at 23-24 Sardar Patel Marg measures 3987.72 square metres and is valued at Rs 54.8 crore. In Lucknow, her bungalow on the Nehru Road in the Cantonment area measures 1.08 acres and is valued at Rs 1,79,92,000. According to the information furnished in the affidavit, Mayawati, who is also president of the Bahujan Samaj Party, has Rs 12.95 lakh in cash and Rs 11.39 crore in bank deposits. Sharad to PM: Include caste in census immediately
New Delhi, May 27 On May 7, the concluding day of the Budget session, the Prime Minister said he would ensure early implementation of the unanimous demand of all parties in the Lok Sabha that caste enumeration be included while recording the other data for census, 2011. But yesterday, following sharp differences among Cabinet members over its implementation, the PM constituted a GoM under Union Finance Minister Pranab Mukherjee. Yadav, who was in the forefront of the demand along with SP president Mulayam Singh Yadav and RJD chief Lalu Prasad, today said: “The delay in taking the decision is damaging because census is on. There is little or no time.” He said: “The PM should have invoked his prerogative and taken a clear decision for caste-based census to gather more information on caste.” Explaining the necessity of caste census, Sharad said: “The proposed Unique cards should carry the name and caste of the person, to prevent him from running around government offices to secure a SC/ST/OBC certificate from his local magistrate.” |

The video, which was uploaded on the day of the killing, shows a man in a yellow jacket with a “kukri” in hand running to where Tamang is lying in a pool of blood, looking at him for a moment and then running away after nearly colliding with another man. A comment below the video said the man in the yellow jacket probably went back to make sure that Tamang was dead. Meanwhile, a Facebook group, “Darjeeling wants peace and not violence” with over 2,000 members is campaigning for peace. A member Xanz Xane wrote, “I firmly believe that if we want democracy, peace and freedom to prevail we need to start from the grass root level people especially those of the Busty's who are the real Public...” Another member Mende Lama wrote: “The public didn't understand him for 40 years... What will they understand now? ... Why fight for a place and people who understand your worth only in death??? It's so not worth it!!!”

New Delhi, May 27 The SP and the BJP have decided to send back yet again two of the yesteryears’ silver screen sirens Hema Malini by the BJP and Jaya Bachchan from the SP to the Rajya Sabha. Hema Malini retired from the Rajya Sabha last year August and Jaya Bachchan’s term is expiring this July. When BJP president Nitin Gadkari constituted his jumbo team of office-bearers on March 16, he appointed Hema Malini, feeling lost and down since she ceased to be a MP, as the party’s vice-president. But 11, Ashoka Road, the BJP headquarters, do not seem to hold much attraction for her because no one her seems to recall when did they last see her there. With the exception of Amitabh Bachchan, whom Rajiv Gandhi brought to the Lok Sabha in 1984, the BJP virtually started a trend when in 1991 it brought into Parliament any number of known film and TV stars, Sita and Ravana from
the Ramayana serial and later Dara Singh, Hanuman of the same Ramayana serial, and Krishna of Mahabharat serial. Most of them did precious little in Parliament. Hema Malini was not exactly in the same category, but she wouldn’t compare with some one like Shabana Azmi, who held forth on any issue with élan. Yet party insiders say she is still a big draw in public rallies and the BJP needs to keep her engaged in party activities. |
Avoid frivolous lawsuits, ministries advised
New Delhi, May 27 The advice was sent as part of the government's effort to develop its National Litigation Policy and seek to reform the judicial system that is "clogged" with frivolous petitions and appeals, a senior law ministry official told
IANS. There are an estimated 30 million cases pending in Indian courts with some cases being tried for decades. "It is reiterated that once a considered view has been expressed by the legal affairs department under the ministry of law and justice, the other ministries and departments should consider acting in terms of the advice tendered," said the official quoting from the communication to other
ministries. "If for some reason, reconsideration of the advice is desired, it should be sought only with the approval of the secretary of the ministry concerned or the department," the communication
said. "On reconsideration, if the advice is reiterated (by the legal affairs department), the department concerned must follow such advice," said the official.

Collapse of temple tower puts govt in fix
Hyderabad, May 27 The 136-ft tall, seven-storeyed majestic structure forms the main entrance of the famous shrine of Lord Shiva in Chittoor district. It was built in AD 1516 by Srikrishna Devaraya, the ruler of the Vijayanagara Empire, to mark his victory over rival Gajapathi kingdom. Though there were no casualties, the collapse of the ancient tower brought to the fore the loopholes in its maintenance. “The maintenance of Rajagopuram does not come under the purview of the state government. We need the permission of the ASI even to carry out minor repairs,” the Chief Minister K Rosaiah told reporters here today. |
Pak ‘spy’ pigeon caught on border
Ramdas (Amritsar), May 27 A white pigeon carrying a Pakistani phone number and address on its body besides a rubber ring in its feet was found by border resident Harbans Lal Saini. SHO Ramdas Jagjit Singh Chahal said he had informed his superiors who have directed that nobody should be allowed to visit the pigeon and an update would be passed to the SSP office atleast thrice in day. The police suspect that the pigeon, which landed in Indian territory, may be on "special mission of spying" and might have been pushed by Pakistan intelligence agency ISI. The pigeon is being kept in an air conditioned room which is being guarded by policemen. A medical examination of the bird was carried out by the doctor from the state animal husbandry department. — PTI |
