Show-cause notice slapped on tehsildar
Jalandhar, September 3 Kanwaljit Singh, the tehsildar, has been asked to appear on September 26. The case relates to non-compliance of orders passed by the state consumer disputes commission in case of one Kanta of Government Colony, Hoshiarpur, who had purchased three plots in Mithu Basti during an auction conducted by the department on August 27, 1981. The commission, in its orders passed on April 25, 2007, had directed the tehsildar to give Rs 60,000 per marla as compensation to the complainant within one month from the date of receipt of the order copy failing which amount so awarded would carry interest at 9 per cent per annum till the payment. After the respondent failed to comply, the complainant knocked the doors of the district forum calling for action against him under sections 25/27 of the Consumer Protection Act. She wrote that plot numbers 6 and 19, both measuring 38 marlas, were purchased by her after making full payment. She has sought for a payment of
Rs 22.8 lakh at 9 per cent interest. The forum today noted that the respondent had been granted sufficient opportunities but he had failed to comply with the notices. It said the respondent during an earlier hearing had requested that in some other case of same nature, the district forum, Jalandhar, had passed an order and other party had filed a CWP No 9185 of 2008 to challenge the jurisdiction of the consumer forum. He had written that the Punjab and Haryana High Court had passed the order and stay had been granted to the respondents. The forum opined, “We have gone through the copy. The case relates to some other case of Mela Ram and others vs state of Punjab but in present case Kanta vs tehsildar no stay has been passed. The respondents are intentionally and wilfully not complying with
the orders passed by the forum.” |

Paper Trouble
Hoshiarpur, September 3 It was further alleged in the complaint that the school committee, when it had applied for the issuance of a chequebook on October 18, 2006, was not provided with the same. The bank authorities, however, said the account of the school was with them and Rajnish Jain and the new secretary and cashier Umesh Jain and Avinash Jain, respectively, did not have the authority to operate the account as it was being operated by Rajnish Jain who was president earlier too along with scretary Tarsem Lal Jain and cashier Parduman Kumar Jain. Requisite documents like the objection or consent letter had not been submitted to the bank by the outgoing committee. The bank further pleaded that there was a civil suit of August 30, 2005, titled Shri Atma Nand Jain Sabha vs Mohan Lal Jain pending in the civil court and the latter had ordered to maintain status quo regarding the existing authority. The dispute with regard to presidentship and other office-bearers was pending in the civil court. Rajnish Jain made a representation to the bank to the effect that he was president of the JSN and he had not authorised any one to operate the said account. The consumer forum held that any order passed in this complaint would affect the future of the students studying at SAV Jain Day Boarding School and keeping in view the interest of the students, directed the complainant to comply with the requisite formalities of the bank branch required for the operation of the account. The forum further ordered the complainant to furnish indemnity bond/surety bond in favour of the Allahabad Bank branch to the effect that in case any loss was caused to the bank branch, he should indemnify the same without raising any objection or protest. |
