Hooda demands separate HC for state
New Delhi, April 19 At present Punjab and Haryana have a common high court based in Chandigarh. Hooda made the fresh demand to Prime Minister Dr Manmohan Singh at the conference of Chief Ministers of states and Chief Justices of high courts. The Chief Minister pointed out that even states created much after Haryana like Jharkhand, Chattisgarh and Uttarakhand have their own high courts. Haryana could easily get its high court by bifurcating the existing premises in Chandigarh, the staff and the judges between Punjab and Haryana in the ratio of 60:40. He pointed out that the civil secretariat and the legislative building were already being shared by both Punjab and Haryana in the same ratio with each having their own entities since 1966. With the establishment of a separate high court for Haryana, not only would the aspirations of the people of Haryana be met, but also the judicial system in the state would be further strengthened, claimed Hooda. Hooda urged the central government to look into the aspect of the introduction of a shift system in courts to ensure speedy justice. There is presently some hesitation to introduce this. The state government was in the process of reviewing all existing state legislations and procedural codes to assess their present day relevance and efficacy and bring in necessary changes where required. He said while realising the importance of modern, integrated infrastructure, Haryana had taken up the construction of modern judicial complexes in a big way. The state government was ensuring that no post of judicial officer was left vacant. The government had created 66 new posts during the last year. He pointed out that the dangers and inconvenience of taking undertrials to courts for hearings was increasing day by day. Haryana had, therefore, embarked on an ambitious project of video conferencing, costing about Rs 8.24 crore. The state’s plan was to link and have video conferencing facilities in 40 courts and 25 jails across the state and these were likely to be made operational within the next six months. In order to make video conferencing operational and legal, in the eyes of law, he said the Indian Evidence Act and the Criminal Procedure Code would have to be amended appropriately. Hooda suggested that the Indian Evidence Act might be amended to make scientific evidence, as substantive evidence instead of opinion evidence. |

Chandigarh, April 19 While politicians and political parties ready for the battle in the state, the elections mean a double date for Haryana Congressmen who have to lend a “helping hand” in the Karnataka assembly elections, which will be held in three phases during the same period. With the Haryana government wanting to leave nothing to chance, it has been decided that the state’s heavyweights will hold fort in the three constituencies while the services of a couple of parliamentary secretaries and MLAs will be offered to the party’s Congress unit for campaign and support. Sources said while all ministers have been retained to wrestle the opposition in the byelections and fire fight for the party, two parliamentary secretaries, Rao Dan Singh and Dr Krishna Pandit, have got “posting orders” to move southward for strengthening the party in Karnataka. They along with 11 others, including MLAs and office-bearers of the Congress, will canvass for party candidates. A list comprising names of “mobile ministers”, that’s how a congressman chose to divide the Cabinet, along with a few parliamentary secretaries and MLAs was initially drawn up for the Karnataka poll. However, this list was scrapped after the government felt the need to keep back the “mobile ministers” since the “inactive ministers in the Cabinet” would serve no use to the party in the bypoll. Following this, a new list was prepared in which the names of all ministers were left out. The “chosen few” from among the Haryana leaders for the outstation assignment have already been told to get in touch with the president of the Karnataka Pradesh Congress Committee and intimate their programme directly to the party unit. Besides MLAs Satvinder Singh, S.S. Bhardwaj, Radhey Sham Sharma, Bharat Singh Chokkar, Bhupinder Chaudhary, the names of HPCC vice-president Chakrvrty Sharma, presidents of DCC Karnal and Faridabad, S.S. Narwal and Harender Pal Singh, IYC general secretary Pradeep Zaildar and HYC spokesman Satbir Yadav are in the list. Meanwhile, the Haryana Pradesh Congress Committee has called a meeting of the Congress Legislature party at the Haryana Niwas to chalk out the strategy for the elections on March 21. However, sources said the party was unlikely to announce its candidates after the meeting, which would be chaired by Chief Minister Bhupinder Singh Hooda. On April 22, HPCC president Phool Chand Mullana will chair a meeting of the party’s coordination committee followed by a meeting of the presidents of the district congress committees and various other committees in a run-up to the bypoll. |
HUDA employee told to vacate house
Gurgaon, April 19 On the petition of estate officer-II, HUDA, Sector 56, Gurgaon, the court of sub-divisional officer (civil)-cum-collector, Gurgaon, J.S. Sangwan ordered that the house in possession of Nihal Singh working as motor operator, HUDA, at Narnaul be vacated with immediate effect on the grounds that as per the government rule, an employee has to vacate the house allotted to him within two months of his transfer to other station. The said employee continued living in house No. 2, Waterworks number 1, HUDA, Sector 40, even six months after his transfer to Narnaul ordered on administrative grounds by the chief administrator, HUDA, Panchkula in October 2007. The house was subsequently allotted to another HUDA employee, but Nihal Singh did not vacate it despite being issued a notice. He was also warned about the legal action in case he failed to comply. Subsequent efforts of the local HUDA office for the purpose went in vain. The respondent, however, prayed that he was being subjected to undue pressure to vacate the house as his family was staying in it. Moreover, his children were studying in Gurgaon. He maintained that this was being done at the behest of another HUDA employee, who bore enmity with him. |
Farm research needs a boost: Sampat
Panipat, April 19 Talking to this correspondent, he said at the Hisar-based HAU, of the total 1,300 posts of scientist, more than 250 were lying vacant. Terming it unfortunate, he alleged that most of the funds were wasted on raising new buildings whereas no serious efforts were being made to appoint scientists and provide them well-equipped laboratories. Similarly, vacant posts of supporting staff, including lab technicians, should be filled to boost the research atmosphere. Otherwise, he added, scientists would prefer the private sector. Highlighting the alleged indifferent attitude of the successive governments towards the R&D sector at HAU, he said there was no increase in the budget allocation since the 70s. He said scores of posts at HAU had got abolished He, however, said despite constraints, farm scientists were working hard to serve the farmers’ interests. Quoting a report in The Tribune on how a large number of scientists at the DRDO were leaving the premier institute, he said serious efforts should be made to provide them a conducive environment in the government sector. Reacting to a statement of Congress MLA from Kaithal and chairman of the All-India Kisat Khet Mazdoor Congress Shamsher Singh Surjewala on farm scientists being careerist, he said it was disappointing to hear such a comment from a seasoned politician. |

With the transfer of the trading business to the distribution companies, the short-term and long-term arrangements of power would be made by the distribution companies. He said the committee would also explore possibilities of cheaper power on a long-term and short-term basis and sale or banking of surplus power during the lean period so that the banked power would be available to the state during the period of demand. The SCPP would review the operations periodically and issue guidelines for the functioning of the HPPC. It would also take strategic decisions with respect to procurement of short-term and long-term power and finalise policy issues. |
PO held for bid to kill villager
Yamunanagar, April 19 He along with others had been booked under Section 307 of the IPC for allegedly making an attempt on life of Nittu Gurjar. As per the complaint of Nittu, Jagtar and others had tried to ambush him on November 19 near a sugarcane field in Bhurkalana village. Jagtar had been evading arrest in the case. He was declared a proclaimed offender and the police had announced a reward of Rs 10,000 for providing information on him. He was arrested from Sipeonwala village of Chhachhrouli after a villager caught him, said sources. Sources said the two youths were spotted moving suspiciously in the village. When Yashpal tried to question them, the two entered into a quarrel with him. Yaspal raised the alarm and took hold of one of the youths while the other escaped. The matter was reported to the police. Sources said two country-made pistols were recovered from the possession of Jagtar, a resident of Kurukshetra district. Jagtar along with others was earlier arrested on April 19, 2007, for his alleged involvement in Maoist activities. The police had recovered arms, including a USA-made revolver, from him. However, he was acquitted by the court. It is to be mentioned here that for the past three years there had been tensions between the Dalits and Gujjar community of the area and on several occasions the two had clashed. It was alleged that certain people having Maoist connections were provoking members of the Dalit community to fight for their rights. |
Change criteria for yellow cards, says Surjewala
Kaithal, April 19 He said landless and unemployed should be issued such cards so that they could get essential goods at subsidised rates. Surjewala said the guidelines issued by the centre government for identification of below poverty line (BPL) families does not hold ground in the prevailing situation, as according to these guidelines anyone having a pucca house, TV or a LPG connection would not be included in the BPL list. He said if this criteria was strictly followed then a large number of families in Haryana, Punjab, Rajasthan and western UP would not be included in below poverty line families. He stressed upon the urgent need to revise the old guidelines so that more deserving people could get benefit under the scheme. Surjewala also put a question mark on the running of various schemes for the benefit of children and women by a number of departments and said if these schemes were implemented through one or two departments then it would be more appropriate and their implementation would become more easy and less time consuming. Clarifying his point further, he said at present different departments were functioning for child welfare, women health, disbursing pension, providing financial assistance under Indira Gandhi Shagun Yojna and various other such schemes. He said the beneficiaries had to run from one office to another to get benefit under such schemes and if these were centralised and concentrated at one place, it would provide much relief to them. Stating this here yesterday, president of the all-India Kisan Khet Mazdoor Congress Shamsher Singh Surjewala said the farming sector required a second green revolution to ensure proper survival of the farming community and a boost to the general economy, which had been affected by the virus of inflationary trend. Claiming that the agriculture had shown a positive growth of 2.5 to 3 per cent in the past four years from the negative growth during the NDA rule, he opined that the government could not just sit over the issue and wait for any automatic change but would have to adopt serious measures if the sector had to be revived. |
7 get life term in two murder cases
Hisar, April 19 Additional District and Sessions Judge, Hisar, S.K. Kaushik has sentenced three persons Ram Chander Dahiya, his son, Sandeep, of Kirmara village in Hisar district and Ashok of Mandhi village in Jind district to life imprisonment on the charge of murdering Naurang of Hisar on November 19, 2003. The court also imposed a fine of Rs 15,000 each. In case of default of payment of fine, they would have to undergo imprisonment for another six months each. The court also imposed a fine of Rs 2,500 on Ram Chander Dahiya under the Arms Act. According to the prosecution, Ram Chander Dahiya, his son Sandeep and Ashok came on a car and fired on Naurang. He was taken to a hospital, where he was declared dead. A case under Sections 302 and 307 of the IPC and Arms Act was registered against him on a complaint of Pawan Kumar of Mittal Nagar. In another decision announced today, Additional District And Sessions Judge Neena Choudhory sentenced four persons Dhan Singh, Satpal, Vinod and Mahabir, alias Kalia, to life imprisonment for murdering Hanuman of Nalwa village (Hisar) on July 11, 2004. All four accused were ordered to pay a fine of Rs 5,000 each. According to the prosecution, these four persons came to the house of Hanuman and attacked with sharp-edged weapons killing him on the spot. A case was registered against them on a complaint of Krishan, son of deceased. Old enmity was stated to be the cause of the crime.

Police department not an industry: HC Chandigarh, April 19 The ruling by a High Court Division Bench, comprising Justice Ashutosh Mohunta and Justice Kanwaljit Singh Ahluwalia, comes on a petition filed by Karnal superintendent of police. It is significant, as cases pertaining to disputes involving workmen in the police department will not come under the labour court’s purview with the pronouncement of the judgement. The superintendent of police had earlier challenged an award passed by Panipat industrial tribunal-cum-labour court on October 24, 2001. The tribunal, in the order, had held the termination of a workman’s services illegal. It had also ordered the workman’s reinstatement, with continuity of service. Directions for paying full back-wages were also issued. Challenging the tribunal’s order, counsel for the petitioner had asserted that the police department was not an industry; and did not come within the meaning of Section 2 (J) of the Industrial Disputes Act. He had further submitted that the function of the police department was sovereign in nature and, hence, was not amenable to the jurisdiction of the labour court. After hearing arguments in the matter, the Bench held: “We are of the considered opinion that the police department performs sovereign and legal functions of the state and, therefore, cannot be subjected to the provisions of Industrial Disputes Act”. The Bench further held: “The arguments of the counsel for the respondent that the case should be remanded back is again rejected, as it would be futile exercise to ask the labour court to determine whether the police department is an industry or not”. Before parting with the orders, the Judges held: “In view of the fact that the police department is not an industry, we allow the writ petition and set aside the impugned award. Counsel for the petitioner submits that the workman has been re-instated in service and his service has been regularised. In case, service of the workman has been regularised, he may continue in service in accordance with law, but he would not be entitled to any back-wages”. |
Chandigarh, April 19 As per the amendment, the executant will be required to produce personally any one among Member of Parliament, Legislative Assembly, local civic bodies, cooperative society, local lambardar, serving gazetted officer or a military officer to attest his identity while getting his documents registered. However, personal attestation will not be required if the executant could produced any of the photo identification documents such as passport, electoral photo identity card, PAN card or any photo identity card issued by the central government, state government or heads of government offices. A circular to this effect issued by the revenue and disaster management department states that the number of specified photo identity documents shall be duly noted by the registering officer in the endorsement of the registered documents as well as in the office copy of the document presented before registration. — UNI |
DGP (prisons) inspects work on jail
Yamunanagar, April 19 Director-general of police (prisons) John V. George today inspected the construction work on the jail, coming up on 40 acres. The jail will have a capacity to lodge 1,000 prisoners. It will have a separate cell for dangerous criminals. George said the jail would be unique in the country as it would be “very spacious”. In other jails, on an average about 25 prisoners use a toilet and there is one bathroom for every 15 prisoners. New jails were also under various stages of construction in Jhajjar with a capacity of 600 prisoners and in Faridabad where 2,500 prisoners could be lodged. The state government had also acquired land for the construction of prisons in Panchkula and Rewari. The DGP inspected the kitchen, school, library, hospital and other infrastructure of the new prison. He said the prison would become operational within six months. |
INLD names Sampat, Bangar, Kashyap for bypoll
New Delhi, April 19 While former finance minister Sampat Singh will contest from Adampur, former chairman of the Haryana Public Service Commission K.C. Bangar will contest from Gohana. Both belong to the Jat community. Ashok Kashyap will be the candidate from Indri. The Election Commission announced the byelections to the Adampur, Gohana and Indri seats after these were vacated following the expulsion of Bhajan Lal, Dharam Pal Malik and Rakesh Kamboj from the assembly. The INLD candidates will file their nomination papers on May 1, 2 and 3 for the Adampur, Gohana and Indri seats, respectively. INLD secretary-general Ajay Singh Chautala will be the election in charge of Adampur, INLD state president Ashok Arora for Gohana and former state INLD president Sher Singh Barshami for Indri. |

BA (final) paper ‘outside syllabus’
Fatehabad, April 19 Students have complained that the question paper set by the university had an essay “Marxian Criticism” by Terry Eagleton, which was not in their syllabus. The question carried 18 marks out of the total 90 maximum marks. Besides, certain objective type questions of two marks each were also not from the prescribed syllabus. Hisar, April 19 According to the police, the deceased have been identified as Rajbir, his brother Ramesh and Shakuntla, wife of another brother Karambir. The incident occurred last evening when they were working in the fields. Three brothers from the same village opened fire at them. Karambir and his daughter Renu were also injured the firing incident and had been admitted to the civil hospital here, the police said. The police has registered a case under section 302 of the IPC and the Arms Act against the accused brothers - Azad Singh, Bhupinder and Rajender, alias Jindi - and their wives along with three unknown persons. Ex-minister’s son commits suicide
Jind, April 19 According to police sources, 27-year-old Vijender, son of Satyanaryan Lathar, a former minister of the Haryana Vikas Party, died at the PGI, Rohtak, where he was admitted last night after he had consumed pesticide in his field. The reason behind the extreme step could not be ascertained as no suicide note was recovered from the spot.
