SC reprieve for Nayak

Mumbai police’s encounter specialist Daya Nayak, who had become a terror for underworld operatives and currently being sought in a disproportionate assets (DA) case, today got a temporary reprieve from the Supreme Court against arrest.

A Bench of Mr Justice K.G. Balakrishnan, Mr Justice G.P. Mathur and Mr Justice R.V. Raveendran said Nayak would not be arrested till February 17 when his appeal against Bombay High Court order, rejecting his anticipatory bail application, would be taken up for hearing.

While rejecting the bail petition of Nayak, the High Court had given him a week’s time to surrender before the Mumbai police’s Anti-Corruption Cell, which wanted him for custodial interrogation in the DA case, registered on January 20.

Nayak’s counsel U.R. Lalit made a special mention of filing of the appeal before the apex court for its urgent hearing in view of the date of his surrender, fixed by the High Court in its February 8 order expiring tomorrow.

He had been suspended by the Mumbai police establishment after the case was registered, accusing him of amassing assets worth Rs 40 lakh, which was disproportionate to his known sources of income.

The High Court had earlier granted anticipatory bail to his wife Komal Nayak, made co-accused in the DA case.
