Based on fresh recommendations of the Supreme Court collegium, President A.P.J. Abdul Kalam today ordered the transfer of the Punjab and Haryana High Court Chief Justice, Mr Justice B.K. Roy, to the Guwahati High Court.

The President had reportedly returned the earlier recommendation of the collegium sometime in December last on the ground that prior consent of Justice Roy for his posting as Chief Justice of the Guwahati High Court had not been sought from him.

Initially Mr Justice Roy was tipped to be posted as Chief Justice of the Patna High Court by the collegium in its proposal to the Law Ministry, sent in October last year.

But the government had not approved it on the ground that it would go against the principle that a judge from his home state could not be a Chief Justice of the same state High Court.

Relations of Mr Justice Roy with his colleagues in the Punjab and High Court had embroiled into a controversy last year after 25 judges had gone on mass leave following their alleged differences with him.
