High Court restriction on retired judges

New Delhi, October 24
In a significant judgement, the Delhi High Court has banned all retired Judges practicing as advocates from taking up cases, which were dealt by them as judicial officers.

Allowing an application in this regard, a Bench comprising Chief Justice B. C. Patel and Mr Justice B. D. Ahmed said, “this court is of the opinion that an advocate who has dealt with a matter in judicial capacity earlier should refrain from appearing in such matters.”

The ruling came after the application raised objection to appearance of a retired High Court Judge as an advocate in a case, which he had dealt with as an Additional District Judge.

Holding that Rule 15 of Delhi High Court is used for indicating impropriety, the Chief Justice writing the judgement said, “it is very clear that the rule-maker indicated that the person who has acted as a Judicial Officer in a proceeding, subsequently in the same proceeding, shall not appear as an advocate”. — PTI
