An account of fake encounter

Jodhpur, June 1
Junior Commissioned Officer P.B. Thapa today told a military court here that his Company Commander Major Surinder Singh “enacted” the fake encounter and got all those involved in it to “swear an oath” not to reveal it to anyone.

“Singh got a bunker constructed and demolished it using heavy explosives. He also got Indian soldiers make movements near the fake bunker and videographed the same,” Naib Subedar Thapa, who was Chawki incharge along the LoC, told Brig Philip Campose, heading the court.

Thapa said he was asked to send false reports of tension.

“Although I told the officer that he was doing a wrong thing, he did not heed to my advice and instead got all those involved in fake encounter take an oath, placing their hands on Lord Hanuman's photo, that they will not reveal anything to anyone,” he said.

Earlier cross examination of the commander of battalion of Gorkha Rifles Col. K.D. Singh, the prosecution witness, was suspended by court when Major Singh demanded that three letters relating to the case claimed to have been written by the witness should be supplied to him and till then the court proceedings should be suspended.

The court gave two options to Major Singh that he either continue cross examining Col Singh on other matters and examine his letters after they are received from the army office or cross examination of the Colonel is suspended till the arrival of letters and recording of evidence of other witnesses is taken up.

Major Singh chose the second option under protest.

Major Singh argued that the recording of evidence of subsequent witnesses would “harm his defence because in the light of deposition of other witnesses, Col Singh would change his version”.

Earlier, in the morning session, the court sustained the objection raised by Major Singh against leveling of allegations of personal nature by Colonel Singh.

Asserting that Major Singh had been falsely claiming that he created the fake encounter at the instance of his senior officer, Col Singh said "because the officer finds himself doomed he wants to sink others also with him”.

Most of the morning session was lost in technical wranglings. — PTI
