SC notice to govt on paper leak
Remand for investigation officer

The Supreme Court today issued notices to the Centre, CBI, Central Board of Secondary Examination and Union Public Service Commission on a petition seeking a foolproof examination system to prevent leak of question papers.

Under the existing system, whether it is a Board, college and university examination or a competition test, the secrecy had often been broken by the miscreants putting the career of lakhs of students in jeopardy, a public interest litigation (PIL) said.

A Bench of Mr Justice S. N. Variava and Mr Justice H. K. Sema, while taking cognizance of the PIL sought replies from the petitioners.

Thought the Bench was initially reluctant to entertain the petition saying “courts are not the panacea for all ills plaguing the society.”

The notice was also issued to the University Grants Commission.

Petitioner Raj Kumar Gupta in his PIL stated that it was high time that the apex Court intervened in the matter as the authorities seemed to have learnt no lesson from the leak of the question papers for several examinations.

Meanwhile, investigation officer of the CBSE All-India Pre-Medical Test paper leak case and his subordinate, arrested by the CBI on the charges of receiving bribe for showing undue favours while probing the case, were remanded in judicial custody for 14 days after intensive interrogation.

Special CBI Judge Pratibha Rani remanded Delhi police Sub Inspector Sanjay Gupta and Constable Umed Singh in judicial remand till May 20.

Meanwhile, suspect in the paper leak, Pradeep Singh Mehra, failed to get anticipatory bail from a Delhi court, which rejected his plea after the police submitted that he had played in “active role” in the pilferage even as another court rejected a request for police remand of three of those already in judicial custody.

Additional Sessions Judge Kawal Inder Kaur dismissed Mehra’s plea saying “in the facts and circumstances, this is not a fit case for grant of benefit of anticipatory bail to him.”

Metropolitan Magistrate Shahabudin dismissed a police request for custody of three of the accused—Satinder, Hemant Sharma and Bhani Gautam—saying that more than 15 days had already expired since they were remanded in judicial custody.

The court also fixed for hearing tomorrow accused MBBS students Nikhil Mehrotra’s plea for interim bail.
