Intercepted phone talk no proof: HC

New Delhi, October 30
In a major setback to the prosecution in the Parliament attack case, the Delhi High Court today held that the intercepted telephonic conversation between accused persons would not be an admissible evidence under POTA.

Setting aside an order of Special Court which held that the intercepted conversation between accused S.A.R. Geelani, a suspended lecturer of a Delhi college, Kashmiri militant Shaukat Hussain alias Guru and his wife Navjot Sandhu alias Afsan was admissible under POTA, Mr Justice M.A. Khan said “the admissibility of intercepted evidence under POTA is specifically barred by Chapter-V of the Act”.
