Tribunal stays recruitment process at Sec 32 hospital
The local bench of the Central Administrative Tribunal has stayed the recruitment process for the post of Assistant Professor (Urology) in Government Medical College and Hospital (GMCH), Sector 32, till the next date of hearing. The Bench has adjourned the hearing of the case for further consideration on January 17.
The Bench has passed the order on an application filed by Dr Mahesh Chandra through advocate KB Sharma.
The counsel for the applicant has submitted that the advertisement regarding recruitment to the post of Assistant Professor (Urology) in the GMCH is illegal as it has not been advertised according to the Union of Territory of Chandigarh Employees (Conditions and Service) Rules, 2022 which were notified on April 1, 2022.
Dr Chandra has prayed before the Bench to issue an interim direction and the respondents (GMCH administration) be restrained from taking further action regarding the recruitment.
Dr Chandra said the maximum upper age limit prescribed in the advertisement was 50 years as under Punjab Civil Service Rules, which is against the Central Civil Service (CCS) Rules and Office Memorandum December 31, 2010, wherein the maximum upper age limit prescribed is 40 years.
The applicant has also relied upon an order dated February 15, 2023, passed by the High Court of Punjab and Haryana in a case titled Rajiv Kumar Kansay Vs UT Chandigarh.
The counsel for the respondents submitted that the Chandigarh Administration had decided to allow operation of Recruitment Rules (as applicable before April 01, 2022) for filling the posts by way of direct recruitment/promotion/deputation till fresh recruitment rules are finalised as per Central Rules. Keeping that in view, the recruitment to the post of Assistant Professor (Urology) has been advertised, he added.
After hearing the arguments, the Bench said in view of the order dated February 15, 2023, passed by High Court of Punjab and Haryana in a case titled Rajiv Kumar Kansay Vs UT Chandigarh, the recruitment to the post of Assistant Professor (Urology) in the GMCH in pursuance of Advertisement dated May 25, 2024, is stayed till the next date of hearing, which is January 17. The Bench said a modification/continuation of the interim order shall be considered on the next date.
