School teacher held guilty for molesting 12-year-student
Dr Yashika, Judge, fast- track special court, has convicted a teacher of a government school under POCSO Act and a case has been registered against him for allegedly molesting a 12-year-old girl student inside the classroom.
The police registered the FIR against the accused under Section 10 and 12 of POCSO Act and Section 354-A of the IPC on November 2, 2022, on the complaint of a girl student. In the complaint the girl said that she was a student at Government Model Senior Secondary School, Chandigarh. She said on the day of the alleged incident in the morning, she was attending a class when she received a message from a student that the class teacher was calling her.
Accordingly, she went inside the classroom, where the teacher was sitting alone on his chair. He then started some obscene talk and also asked some uncomfortable questions and also touched her inappropriately. Out of fear, she left the class immediately and did not tell anything to anyone. After the school got over, when she reached home she narrated the entire incident to her father. Following this, they decided to lodge a police complaint.
Counsel of the accused argued that the latter had been falsely implicated in the case. He said that the complaint was filed as the teacher had seen the girl one month before the alleged incident with some boys and scolded her. He said that in order to create pressure not to disclose the incident to her parents, she had filed the complaint.
On the other hand public prosecutor argued that the girl remained consistent in her statement. After hearing the argument the court convicted the accused for the charges framed against him. The court will pronounce the quantum of sentence on November 8.
