Lok Adalat issues warrant of attachment for PUDA Bhawan

The Permanent Lok Adalat (Public Utility Services) has issued a warrant of attachment of the PUDA Bhawan, cars of Chief Administrator and Estate Officer, besides furniture and air-conditioners installed at the Sector 62 office. The order came in connection with a case related to deficiency in service in the sale of a flat worth Rs 82.38 lakh to Sector 69 resident Tarsem Kansal in 2012.

The court ordered the Greater Mohali Area Development Authority (GMADA) to pay the principal amount and interest, amounting to Rs 2.31 crore, and return the warrant to the court on or before December 30.

The court also ordered the attachment of GMADA’s two bank accounts. “You are further directed to make a demand draft for Rs 2.31 crore from the attached bank account in favour of Tarsem Kansal and send that to the court on or before December 30 with an endorsement regarding the execution of the warrant,” the order read.

The Branch Manager, Axis Bank, Nodal Branch, Mohali, who had sent information to the court that the said bank account for attachment had a lien of Rs 30 lakh, without communicating the remaining amount in the account, has also been summoned by the court.

“You are directed to prepare a DD favouring the applicant and send that to the court over and above Rs 30 lakh (lien) on or before December 30. Further, you are summoned to appear in person or through attorney on December 30,” read the summon issued to the bank branch manager.

GMADA Chief Administrator Moneesh Kumar said, “I will not be able to comment on it as I have yet to see the document.”

Tarsem Kansal (59), a resident of Sector 69, was allotted a Type-3 apartment in Tower B, worth Rs 82.39 lakh, in Purab Apartments, Sector 88, in 2012. According to the term and conditions, the due payment was completed by 2016, but GMADA failed to complete the project in time (by May 22, 2015).

The Permanent Lok Adalat awarded refund amount, interest and compensation to Kansal in 2021. GMADA, however, got a stay from the high court. On July 31, 2024, the HC disallowed the GMADA petition. On August 25, 2024, the Permanent Lok Adalat issued a warrant of attachment of GMADA bank accounts.
