FIR quashed after travel agent, victim reach compromise

The Punjab and Haryana High Court has quashed an FIR in a breach of trust and cheating case after a travel agent reached a compromise with a victim.

Allowing the petition for quashing the FIR, Justice Harnaresh Singh Gill said the parties were directed to appear before the trial court for getting their statements recorded. In compliance thereof, a report of the Sub-divisional Judicial Magistrate was received, saying that the parties had arrived at an out-of-court settlement.

The alleged travel agent, Simsom Anand, a resident of Rohini, Dehli, had a filed a plea for quashing of FIR No. 213 (7.10.2016) under Sections 406 and 420, IPC, and Section 24 of the Immigration Act, 1983, registered at the Nakodar police station and subsequent proceedings on the basis of compromise arrived on July 6, 2019, between the parties.

The police had booked Anand for duping Varun Kapur of New Adarsh, Shankar Road, Nakodar of Rs 19 lakh on the pretext of sending him to the US.

The High Court said the trial court was directed to record the statements of the parties with regard to the genuineness and authenticity of the compromise.

In compliance thereof, the Sub-divisional Judicial Magistrate, Nakodar, had submitted a report indicating that the parties appeared before the magistrate and recorded their respective statements with regard to the validity of the compromise. As per the report, the compromise was genuine and voluntarily.
