Man gets life imprisonment, fined Rs 20K in two-year-old murder case

A local court has sentenced Gurudutt Mishra, a resident of Colony No. 4, Industrial Area, Phase 1, Chandigarh, to undergo life imprisonment in a murder case registered two years ago. The prosecution managed to prove the case despite the fact that the complainant turned hostile. The CFSL reports proved that blood found on the knife belonged to both deceased and the injured person.

The police registered the case on December 13, 2022, for the offences punishable under various sections of the IPC on the complaint of a person named Rishabh Dhangar. He said he was residing at Hallo Majra village, Chandigarh, on rent and working at an ice-cream parlour in Elante Mall. On December 13, 2022, after completing his work, he, along with his friend Ritesh, hired an auto to reach their home. When they reached near Ram Darbar, a person on a motorcycle came and started abusing them and started following them.

Thereafter, the motorcyclist parked his bike on the roadside and hit him and his friend on their neck with some pointed weapon and fled the spot. Both were injured in the attack. They were taken to GMCH-32 for treatment. Later his friend Ritesh died during treatment. On the basis of the said statement, the FIR was registered. The accused was arrested and the motorcycle, documents and weapon of offence were taken into possession.

On completion of investigation, a report under Section 173 (2) CrPC was prepared and presented in the court. Charges were framed against the accused. Counsel of the accused argued that the he had been falsely implicated in the case. He claimed that the complainant had also not supported the case of the prosecution.

On the other hand Manu Kakkar, District Attorney, argued before the court that the prosecution had proved the case on the basis of the scientific and circumstantial evidence. He said the CFSL reports proved that blood found on the knife belonged to both deceased and the injured person. Besides, the accused failed to explain as to how he was in possession of the knife. After hearing the arguments the court sentenced the convict to undergo life imprisonment and also imposed a fine of Rs 20,000.
