Opposition initiates move to impeach judge over controversial remarks

The opposition INDIA bloc has initiated efforts to impeach Allahabad High Court judge Justice Shekhar Kumar Yadav over his controversial remarks targeting minorities during an event organised by the Vishwa Hindu Parishad’s legal cell on December 8.

Trinamool Congress Lok Sabha member Mahua Moitra confirmed her participation in the initiative, posting on X, “Happy to have signed the impeachment motion against Allahabad HC justice Yadav along with other AITC MPs.”

Ruhullah Mehdi, Lok Sabha member from Srinagar, is leading the campaign to gather the necessary 100 signatures from MPs to move the impeachment motion under Article 124(4) of the Constitution. Mehdi, in a post on X, stated, “I am moving impeachment motion in the Parliament…for the removal of this Justice, namely Shekhar K Yadav, on the charges mentioned in the notice.”

Mehdi revealed that MPs including Asaduddin Owaisi (Hyderabad), Rajkumar Roat (Rajasthan), Sudhama Prasad (Bihar), Jinab Mohibbullah (UP), and Jinab Ziau Rahman (UP) have already signed the motion, with many others extending their support.

The proposed motion shared by Mehdi highlights the charges against Justice Yadav, accusing him of “proved misbehaviour.” It states, “Justice Yadav’s remarks during a public event demonstrate bias as he overtly expresses preference for a particular religious majority and their cultural practices.”

Similar efforts are underway in the Rajya Sabha. Congress MP Vivek Tankha is reportedly coordinating the initiative and has collected 36 signatures from Rajya Sabha members.

The impeachment process requires significant political and procedural coordination, marking a rare move against a sitting judge.

38 signs collected

Thirtyeight signatures have been collected but the formalities of signatures for the notice could not be completed on Wednesday as the Upper House of Parliament was adjourned early and many MPs had left. The required signatures of at least 50 MPs will be collected by Thursday and they will go ahead with the notice in the next few days. PTI
