Next hearing in Sanjauli mosque case scheduled on Nov 14
The District Court will take the decision regarding the maintainability of the petition filed by All Himachal Muslim Organization representative Nazakat Ali Hashmi on November 14. The court will also take the decision regarding making the local residents of Sanjauli party in the case.
The court today heard the petition filed by Hashmi in which he had urged for stay on the decision to raise the top three floors of mosque in Sanjauli. Apart from this, the local residents also filed an application requesting to be allowed to be the party in this case. After hearing both parties, the Court scheduled November 14 the next date of the hearing of the case.
In the last hearing that was held on November 6, the court had denied the All Himachal Muslim Organisation to grant stay orders against Commissioner Court’s decision to raze the top three floors of a mosque in Sanjauli.
The organisation’s representative Nazakat Ali Hashmi had challenged the decision of Commissioner’s Court that was taken on October 5. The organisation had argued that it had donated funds for the construction of the mosque, therefore he is aggrieved. It was also argued that Muhammad Latif, who is the president of Sanjauli Mosque Committee, was not an authorised person. Therefore, Latif cannot offer to raze the top three floors of the mosque.
After Commissioner’s Court order to raze the top three floors of the mosque in October, All Himachal Muslim Organization had held a meeting in Shimla during which it was unanimously decided that the organisation will challenge the decision in the court of appellate authority and will also approach the Supreme Court, if necessary. The two Muslim organisations remained divided over the decision as the Sanjauli Mosque Committee proceeded to initiate the demolition work as per the orders of Commissioner’s Court.
