Hand over possession of unit: Regulator to builder
In a big relief to a homebuyer, who was waiting for the possession of his unit for over four years, the Haryana Real Estate Regulatory Authority (HRERA) directed Pareena Infrastructures Pvt Ltd to hand over the unit within 30 days from the date of the order (November 8).
While adjudicating the matter, Arun Kumar, Chairman, Haryana Real Estate Regulatory Authority, also ordered Pareena Infrastructure Pvt Ltd to pay delayed possession (DPC) charges to the homebuyer. The DPC must be paid at 11.10 per cent interest annually.
The complainant, Tarakeswar Das, had booked his unit at Micasa in Sector 68, Gurugram, in 2016 and the possession was due in 2020. The respondent is directed to execute the conveyance deed in favour of the complainants after settling the dues, if any, within 90 days from the date of this order, said the authority.
“There is a delay on part of promoter to offer the possession of the allotted unit to complainant as per the terms and conditions of the agreement. It is a failure of the promoter to fulfil its obligations as per the agreement,” said the authority.
