Chandigarh, April 11

The state of Punjab today told the Punjab and Haryana High Court that actor Sarabjit Singh Kalsi, alias Daljit Kalsi, had not been arrested under any penal provision of law, but had been detained under the provisions of the National Security Act.

Justice NS Shekhawat’s Bench was also told that Kalsi was a close associate of pro-Khalistan activist Amritpal Singh. It was added that Kalsi was actively supporting Amritpal in his activities and was himself indulging in activities prejudicial to the security of the state and the law and order situation.

The reply by Amritsar (Rural) Senior Superintendent of Police Satinder Singh, placed before Justice Shekhawat’s Bench, added the intimation of detaining him was given to his wife Narinder Kaur as well as the quarters concerned in accordance with law.

It was added: “Kalsi has been supporting Amritpal in professing radical ideology and raised the demand of secession of Punjab from India by violent means. He also had been supporting Amritpal actively abetting/ instigating/ provoking/ motivating/ conspiring to wage war against the state for a separate nation by name of Khalistan.”

Describing as “wring and incorrect” the allegations that Kalsi had been kept in illegal custody without following the due procedure of law, it was stated that the detainee was in legal detention. As such a habeas corpus petition was not maintainable.

Kalsi was arrested as a part of the Punjab Police’s crackdown on “Waris Punjab De” before being flown to the Dibrugarh Central Jail in Assam. Justice Shekhawat also directed the listing of the matter on April 24 for final disposal.

In her petition, Narinder Kaur alleged the sanction to impose the National Security Act was to be given by the District Magistrate before approval by the Home Department.
