Led by Chief Justice of India DY Chandrachud, the Collegium turned down Justice Ahmed’s request to reconsider its recommendation to transfer him to the Madras HC. “We have considered the request made by Justice Shamim Ahmed in his representation. The Collegium does not find any merit in the request made by him. The Collegium, therefore, resolves to reiterate its recommendation dated August 21, 2024 to transfer Justice Shamim Ahmed to the Madras HC,” the Collegium resolution read.

Other members of the Collegium who were part of the decision included Justice Sanjiv Khanna, Justice BR Gavai, Justice Surya Kant and Justice Hrishikesh Roy.

In terms of the Memorandum of Procedure for appointment of transfer of HC judges, the Collegium also consulted one of the Supreme Court judges conversant with the affairs of the Allahabad HC in a position to offer views on the proposed transfer and as also the chief justices the Allahabad HC and the Acting Chief Justice of the Madras HC, the resolution stated.

Originally, the decision to recommend the transfer of Justice Ahmed of the Allahabad HC to the Madras HC was taken on August 21 and on Friday, the Collegium reiterated its decision after turning down his request to reconsider it. In a major judicial overhaul, the Collegium had in August last year recommended transfer of 23 judges from eight high courts.
