The court of Chief General Manager, CITCO, has issued an eviction notice to the allottee running a liquor vend and a tavern in an open space of the CITCO shed complex in Mauli Jagran village here. The allottee continues to occupy the space despite the expiry of contract and has failed to pay rent for the period thereafter.

According to the notice issued by the court of Amit Kumar, Chief General Manager, CITCO, exercising the powers of Estate Officer, under Section 7 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, the contract of open space allotted to M/s AK Enterprises, ex-licencee of open space (500 sq ft) CITCO Shed Complex, Mauli Jagran, expired on March 31, 2023, but the proprietor has not handed over the possession of the space to CITCO.

The court ordered M/s AK Enterprises (through its proprietor Arvind Kumar Singh) to vacate the premises within 15 days. In the event of refusal or failure to comply with this order within the stipulated period, the firm is liable to be evicted from the premises, if need be, by the use of such force as may be necessary, stated the court.

Rent arrears worth Rs 27.33 lakh were pending against the proprietor from April, 2023, to October, 2024, in respect of the premises.

"The proprietor is liable to pay an interest at the rate 18% per annum to CITCO on the arrears till its final payment," stated the court.

"I call upon you to show cause on or before October 30, 2024, why an order requiring you to pay the said arrears of rent together with interest should not be made and the security deposit of Rs 12,90,186 lying with CITCO should not be forfeited," stated Amit Kumar, in the order.

In another case, the court also issued eviction order against Renu Garnal, Shed No. 8 at the same complex.

According to the order, the allotment of Shed No. 8 was terminated on January 27, 2021, but the proprietor has not handed over the possession of the space to the corporation.

He ordered Renu Garnal to vacate the premises within 15 days. In the event of refusal or failure to comply with this order within the period specified above, Garnal and all other persons concerned are liable to be evicted from the said premises, if need be, by the use of such force as may be necessary.
