303 TGT posts: CAT restrains Chandigarh from declaring result

The Chandigarh Bench of the Central Administrative Tribunal (CAT) has directed the Education Department to decide the eligibility issue of a candidate before declaration of the final result for filling 303 TGT posts. The Bench has passed the order on an application filed by Meena Devi of Haryana through advocate Rohit Seth.

She said that the department had invited applications for filling 303 TGT posts vide an advertisement dated February 9. She holds degrees in BA and B.Ed. Being eligible and qualified, she submitted her online application for the post of TGT (social studies) under SC category and the admit card was issued by the respondents.

The written examination was held on June 22. She passed the examination and stood third on merit against four posts meant for SC category. The department called the candidates who had qualified in the written test for the verification of the documents.

But she was declared ineligible with remarks ‘B.Ed degree or its equivalent recognised by NCTE with social studies/social science as teaching subject with at least 50% marks not done, to be declared ineligible’.

Counsel of the applicant said that aggrieved by the action, she submitted a representation to the Director, Education Department, Chandigarh Administration, on October 11 along with clarification issued by the university. He said that the department had not taken a decision on it yet. He said that the decision of the respondents was not against the rules and regulations. The counsel also submitted that he did not want to stall the recruitment process and wanted speedy disposal of the representation of the applicant.

After hearing the arguments Suresh Kumar Batra, Member (J), said, “Since the contention of the applicant on the basis of supporting documents is under consideration by the respondents in the tribunal, it deems it appropriate to dispose of the application without entering into the merits of the case with a direction to the respondent to consider and decide the representation of the applicant by passing a reasoned order before declaration of the final result for the posts of TGT. However, the applicant is at liberty to avail of legal remedy as per law if she is unsatisfied with the decision of the respondents, it added.
