20-year-old acquitted in NDPS Act case
A local court has acquitted Rahul (20), a resident of Mauli Jagran, in a case registered under the NDPS Act after the prosecution failed to prove charges .
As per the prosecution, the police arrested the suspect on December 8, 2017, with 250 gm of ganja from near the Mauli Jagran Railway Station. The police claimed that the person failed to show any permission for keeping the material.
After investigation the police filed charge sheet against the accused under Section 20 of the NDPS Act. Finding prima facie case charges were framed against the accused to which he pleaded not guilty and claimed trial.
Arvind Sandhu, counsel for the accused, argued that the prosecution failed to prove the case beyond a shadow of doubt. He said the sample was sent to the CFSL after a delay of over 72 hours and the delay was not explained. No independent witness joined despite availability at the spot. Besides major contradictions were reported in the statements of the witnesses. After hearing of the arguments the court acquitted the accused of the charges framed against him.
