The Punjab State Consumer Redressal Commission has sentenced the Managing Director of Sunny Enclave, Jarnail Singh Bajwa, to two-year imprisonment for unfair trade practices. He was also directed to pay a fine of Rs 10,000 by the court.
A complaint was filed by Sector 49 resident Harjinder Singh stating that he had paid Rs 20 lakh for a villa in a project of Mariner’s Biuldcon in Mohali eight years ago. There was a pact between Bajwa Developers and Mariner’s Buildcon. However, the construction of the project did not start for years on end. Harjinder thus demanded a refund, which was not given and Harjinder moved the commission.
In 2016, the commission ordered a refund of Rs 20 lakh, along with Rs 2 lakh compensation and Rs 21,000 as litigation costs. However, the order was not complied with and Harjinder filed an execution petition last year. The current order has found Bajwa Developers equally guilty in the case.
The project was in Sector 123, Mohali, and promised 200 independent villas. According to the complaint, by September 2012, Harjinder had paid Rs 20 lakh through four cheques. In June 2013, Harjinder was allotted a 300 yard villa. However, the company did not start its construction.
