Arrest orders against realty firm directors

The Haryana Real Estate Regulatory Authority (HRERA), Panchkula, has issued arrest orders against directors of Ireo Fiveriver Private Limited for non-compliance with its directions to refund payment to a customer.
The HRERA, in its order, held that the directors of the firm neither reply nor appeared before it.
Desh Ram Dhankhar and Santosh Dhankhar, Suman Lata Davessar and Jawahar Lal Davessar, Sanjay Kumar Narwal and Piyush Babarwal, had filed a complaint with the HRERA through counsel Himanshu Raj.
While exercising its power under Order 21 Rule 37 of the Code of Civil Procedure, 1908, the authority had issued a show-cause notice to the directors of the realty firm asking them as to why they shall not be sent to civil imprisonment for not refunding the amount, as ordered, to the complainant against the sale of a plot.
The realty firm was asked to refund the amount, along with interest as prescribed under Rule 15 of the Haryana Real Estate (Regulation and Development) Rules.
In a bid to bring transparency and accountability to the real estate sector, the Centre had enacted the Real Estate (Regulation and Development) Act, 2016. The HRERA was established under the Act.
The key components of HRERA include regulating real estate sector for its harmonious growth and development. Making sure that real estate projects are completed in time frame and resolving disputes related to the projects expeditiously are the objectives of HRERA.
