Honda Siel Cars, local dealer penalised
Tribune News Service

Chandigarh, August 17
Honda Siel Cars India Limited and its dealer Lally Automobiles have been directed by the District Consumer Disputes Redressal Forum to pay Rs 30,000 compensation to a Sector-30 resident for deficiency in services.

Complainant Kamla Devi alleged she had purchased a Honda City car inMay 2010. Her grievance was with the regard to a dent in the front bar ofthe chassis of the vehicle, which she noticed only after one and a half years of thepurchase of the vehicle. She claimed that since the vehicle had notmet with an accident during her ownership, the dent in the front bar of the chassis of the vehicle could only mean that accidental and second-hand vehicle was sold to her.

Denying allegations, Honda Siel Cars India Limited and its dealer, Lally Automobiles private limited (Prestige Honda) in Industrial Area, said the dent could have occurred due to rash and negligent driving by the complainant herself.

“Even though the allegations of the complainant are not really proved, yet her anxiety on realising the dent in the vehicle cannot be overlooked, even if there is no hindrance to the running of the vehicle. In the given situation, though we cannot pass orders to replace the vehicle or refund the price, we deem it appropriate to allow this complaint only to order the manufacturer and the dealer to pay a consolidated compensation of Rs 30,000,” the forum held.

“As it is not proved whether the dent is on account of the manufacturer or by the dealer, the amount will be shared equally by them. They will also pay Rs.10,000 towards the costs of litigation, which will also be shared equally by them,” the forum further directed.

stolen Activa
National Insurance told to pay relief
Tribune News Service

Chandigarh, August 17
National Insurance Company has been directed to pay Rs 44,159 paid by a complainant for insurance earlier and Rs 10,000 as compensation for deficient services.

The District Consumer Disputes Redressal Forum has also directed the company to pay Rs 7,000 as the cost of litigation. Pavneet Singh, the complainant, alleged that he purchased a Honda Activa and got it insured with the opposite party for the period October 30, 2012, to October 29, 2013.

The complainant said on October 8, 2012, his cousin took the vehicle to Sector 36 market and parked it there from where it was stolen by some unknown persons. He alleged that on the day of theft, the complainant visited the office of the opposite party and informed about the theft, but they were allegedly told to come after four to five days. When the complainant visited the office of the opposite party on December13, 2012, he was told to come on December 15, 2012.

Later, the opposite party allegedly took the stand that the claim would be lodged only after the registration of an FIR. The complainant lodged an FIR at the Sector 36 police station, however, the claim was rejected.

In its reply, the opposite party averred that the vehicle was stolen on December 8, 2012, whereas the intimation was received by it on December 17, 2012, after which the claim was registered. Then a request for deputing the investigator was made and a letter was written asking for delayed intimation. It has furtherbeen averred even after passage of 30 days of the purchase of the vehicle, the complainant did not apply for its permanent number and at the time of theft it was still having temporary number, which was in violation of law.

.“We are of the view that there is no merit in the contention of the opposite party that there was delay on the part of the complainant in intimating it about the theft and the same seems to be an afterthought. The registration of the vehicle and the incident of theft, were two absolutely different matters having no link whatsoever,” the forum ruled.
