tavera-audi mishap Tribune News Service
Chandigarh, December 19 The case also saw the Chandigarh Police seeking additional time for specifying its stand on adding more serious offence of “culpable homicide not amounting to murder” under Section 304 of the Indian Penal Code. The police claimed that reports into the accident were awaited and it would make clear its stand after going through the same. The Central Forensic Science Laboratory also sought additional time to submit its report on the accident. After hearing the arguments for almost an hour, Justice Amol Rattan Singh also directed the CFSL to submit its report by January 14. The case will now come up for hearing on January 22. Justice Amol Rattan Singh, on the previous date, had asked the police to specify its stand on adding more serious offence of “culpable homicide not amounting to murder” under Section 304 of the Indian Penal Code. The query assumed significance as the Section attracts a maximum imprisonment of 10 years. As of now, the first information report in the matter has been registered for death due to “rash and negligent driving” under Section 304-A of the IPC, which carries a maximum sentence of two years imprisonment. Justice Amol Rattan Singh was also not too pleased with the inability of the Central Forensic Science Laboratory to specify the vehicle speed as the Audi involved in the accident was not available to it. The directions came on a petition filed by Yash Pal Juneja, who lost his 21-year-old son in a fatal accident. Two college students from Ghaziabad and the taxi driver had died on the spot when their Chevrolet Tavera was hit by a luxury SUV Audi Q7 that crossed over the divider and rammed into the taxi. The accident occurred on July 24. Initially, the Chandigarh Police had registered a case against the taxi driver who died in the accident. It was only after a hue and cry was raised that a case was registered against the SUV driver. Juneja has alleged that the accused is close to politicians and high-ups and is influencing the investigation done by the Chandigarh Police. |
