Tribune News Service

Chandigarh, October 2
The UT Consumer Disputes Redressal Commission has dismissed the appeal filed by Dynamic Motors and upheld the orders of the District Forum penalising the company for selling a two-year-old model of a car to a person projecting it to be a latest model.

The forum had directed the company to pay a compensation of Rs 2 lakh to the complainant for 'keeping the complainant in the dark and deceiving him'.

The complainant had filed a complaint stating that he had purchased a Chevrolet Aveo (LS) car from Dynamic Motors, Industrial Area, in February 2011.

After using the car for about 10 months, the complainant wished to avail the exchange offer at Dynamic Motors and took his car for sale to the latter’s office.

However, he was told that the car was a 2009 model and the sale amount would be in accordance with the model.

The forum held that 'there was sufficient evidence to prove the fact that the opposite party (Dynamic Motors) had sold a car of the 2009 model representing it to be a 2011 model'.

The forum stated, “The contention of the opposite party (Dynamic Motors) that the complainant knew that the car was manufactured in December 2009 could not be accepted."
