The petitioner, Matte Khan, a resident of Chaurhwala village, had averred that he had got extended the load from 7.5 BHP to 10 BHP on March 3, 2011 and deposited the requisite fee for extending the load of the motor. He claimed that he had never used the excess load of 5 BHP and further added that respondents also intended to disconnect his motor connection. However, after he requested for not disconnecting his motor the respondents asked him to deposit 20 per cent of the penalty amount, which was deposited by him under protest. The counsel for the respondents while denying the averments made by the petitioner said a penalty of Rs 28,500 had been imposed after the SDO concerned had submitted his checking report on July 5, 2013. Later on July 26, 2013 the XEN had made the statement before the Lok Adalat that the petitioner had deposited Rs 5,000 as load surcharge and added that they would be rechecking the motor load within 7 days. He said that after the respondents found the load of the motor 10 BHP they decided to forgo the rest of the amount as the earlier report of the SDO was found to be concocted and appealed for the disposing of the case. |
