Decision to amend liquor policy midway under HC scanner
Tribune News Service

Chandigarh, July 25
The Chandigarh Administration’s decision to midway amend the 2013-14 liquor policy has come under the Punjab and Haryana High Court scanner. After initiating the process of allotting the liquor vends, the administration allegedly amended the policy abruptly, enhancing in the process the earnest money payable for the allotment of liquor vends.

The development is significant as no less than 90 vends in Chandigarh are affected by the amended policy. It transpired during the course of hearing that the Chandigarh Administration had initiated the process of allocating more than 200 vends in the city. While most of the liquor vends were allocated in accordance with the policy earlier announced, the administration came out with the new policy affecting 90 vends yet to be allocated for 2013-14.

As the matter came up for hearing, the Division Bench of Justice Rajive Bhalla and Justice Bharat Bhushan Parsoon issued notice of motion to the Administration and other respondents on the petition challenging enhancement of earnest money payable for the allotment of remaining 90 liquor vends in Chandigarh.

The notice was accepted by the UT senior standing counsel on behalf of the Chandigarh Administration. The case will now come up for further hearing on August 2. Counsel for the petitioners Vikram Jain contended the minimum reserved price for each vend was specified by the Administration in the excise policy announced for 2013-14. The earnest money payable for each vend was also notified. Most of the liquor vends were allotted on the basis of the excise policy so announced. But all of a sudden, the department enhanced the earnest money payable for allotment of pending vends.

Jain, also Haryana Additional Advocate-General, added the earnest money payable for the allotment of liquor vends with a licence fee up to Rs 60 lakh was Rs 7 lakh as per initial excise policy. It was increased to Rs 35 lakh, irrespective of the minimum reserve price.

Jain contended small players would be ousted as a result of the enhancement. It would result in monopolisation of the trade by “big players”. Pointing at the irrationality of the new policy, Jain said in some cases the earnest money was more than the total licence fee for the entire licensing period. It was totally unheard of and out of proportion, he contended.

On behalf of the prospective bidders, Jain submitted that the rules of the game stood changed by the alteration in the excise policy, something not permissible in terms of law settled by the Supreme Court.

Notice of motion issued

As the matter came up for hearing, the Division Bench of Justice Rajive Bhalla and Justice Bharat Bhushan Parsoon issued notice of motion to the Administration and other respondents on the petition challenging enhancement of earnest money payable for the allotment of remaining 90 liquor vends in Chandigarh.
