Harry Hyperstore told to pay
Rs 25,000 compensation
Chandigarh, March 14 Karnica, a resident of Sector 18, had purchased "Tiffany orange cream wafer" from Harry Hyperstore, Sector 26, in February 2009. When she was eating the wafer, she felt some semi-solid substance in her mouth. She felt giddiness and was treated for vomiting and diarrhoea from Government Multi-Specialty Hospital (GMSH), Sector 16. A complaint was filed in the District Consumer Forum, Chandigarh, which found that a rubber band was embedded in the wafers. A compensation of Rs 1,000 was awarded. Upon appeal, the Chandigarh State Commission enhanced the compensation to Rs 7,000 in all. Another appeal was filed by the consumer in the national commission. Counsel for the complainant Pankaj Chandgothia contended that Tiffany Wafer was an imported product and was not labelled properly in violation of Section 32 of the Prevention of Food Adulteration Act, 1954. The name and address of the importer was not mentioned. The store took the objection that there was no laboratory report in favour of the complainant. The national commission observed that the medical evidence and observation of the district forum was sufficient to prove the case against the seller. "Though the price of the product is negligible, but substantial compensation should be awarded in such cases so that it acts as a deterrent to the traders not to indulge in unfair trade practise," said the counsel. The national commission directed the store to pay Rs 25,000 to the complainant within 45 days . "The wafers sold by it are injurious to health, therefore we impose further costs and the respondent store is directed to deposit Rs 25,000 with the Consumer Welfare Fund established by the Central Government within 45 days,” said the order. |
