CTU
buses' insurance Saurabh Malik Tribune News Service
Chandigarh, January 12 Information provided to the Punjab and Haryana High Court by a “public-spirited person” and an active member of the Chandigarh’s Advisory Committee, Devi Dayal Sharma, suggests that about 160 CTU buses are off road for the want of requisite exemption or insurance cover. Taking up Sharma’s petition filed through counsel Ranjivan Singh, the High Court yesterday issued a notice of motion to the UT Administration and other respondents. In his petition, Sharma said the Chandigarh Transport Undertaking, popularly know as CTU, was established in 1966 by the respondent Administration with a fleet of about 30 buses to provide cheaper mode of public transport. A corpus fund was established by the CTU and the Administration in 1988 to meet third party accident claims in view of the Section 146 (3) of the Motor Vehicle Act - 1988. Accordingly, the buses could ply on roads without insurance cover. For 2012-13, the CTU established a fund of Rs 1.70 crore, the petitioner added. But, a formal exemption from sub-Section 3 of Section 146 has not been granted in the recent past; and the State Transport Authority is not allowing the buses to ply on roads. “Consequently, about 160 buses are off road and are parked in various depots of the CTU. By the end of January 2013, about 50 more buses are likely to be off road on account of the said reason,” Sharma said. He said: “A peculiar situation has arisen because neither insurance companies are inclined to insure the buses nor the appropriate government or the UT Administration is ordering formal exemption under Section 146 (3) despite the fact that a fund to meet accident claim has been established by the CTU, and presently, the fund for 2012-13 is Rs 1.70 crore”. Referring to a news item carried in these columns, Sharma said: “On account of this situation, it is not only the general public who is at the receiving end, but also the CTU is suffering financial losses in lakhs on a daily basis for the negligent/callous attitude of the higher/competent authorities for the reasons best known to them. By doing so, whose interest they are watching, one fails to understand”. Sharma insisted that even the CTU Workers Union underscored the issue and brought it to the notice of Railways Minister Pawan Kumar Bansal. |
