How to take on teleshopping network

I bought a magnetic massager for Rs 3,000 from a teleshopping network. However, every time I used it I got a headache. The network had assured me that I could return it if I was not happy with the product for a full refund, within 10 days. However, when I called their call centre, they said I should contact the manufacturer. The manufacturer never responded. Now the 10 days are already past. Can I still return it? Who should give me the refund: The teleshopping network or the manfacturer?

Do not worry about the 10-day limitation period. You have already called up the network's call centre and informed them that you want your refund. If there is a delay on their part in getting back to you, then it is their problem. In any case, if the product is defective or unsafe or if its performance does not match the claims made by the teleshopping network, you are entitled to a full refund. That's your right under the Consumer Protection Act. So write to the teleshopping network and ask them to refund your money and take back the product.

As to the second part of your question, let me quote a decision of the National Consumer Disputes Redressal Commission vis-à-vis a teleshopping network. I would suggest that you quote this case when you write to the network. The complaint here pertained to a set of jewellery costing Rs 8,200 ordered by L.K.Pandya from a teleshopping network in 1995. When it reached the consumer, the parcels did not contain the promised jewellery.

Before the consumer court, the teleshopping network argued that it cannot be held liable for non-delivery of goods as it had no contract with the consumer. It was neither the supplier nor the manufacturer of goods, nor had it taken any payment The District Consumer Disputes Redressal Forum disagreed and pointed out that the consumer had sent the money to the teleshopping network. Besides, the sky-shop had shown , through its telecast, its ability to provide the jewellery on receipt of a certain amount and on the basis of this, the complainant had ordered the product, this amounted to an agreement. By failing to deliver the promised jewellery, the teleshopping network was guilty of deficient service and unfair trade practice. The Forum directed it to pay Rs 34,700, along with interest at the rate of 18 per cent per annum.

Confirming this view, the National Commission pointed out that despite the insurance cover, the teleshopping network failed to respond to the complaint and ensure delivery of the ordered products. This not only amounted to deficiency in service, but also to an unfair trade practice.. (Asian Sky shop vs L.K.Pandya, R.P.No 986 of 2002, decided on 15-7-2002)

Television channels marketing household appliances claim that their price is the lowest? Should one buy from them?

I would suggest that you note the model being marketed and check its price on the internet. It is also good to read reviews about it and also verify if there are consumer complaints about the model and also about the telemarketing channel. (You can do it all on the internet). It's also good to confirm whether the model is old or new. 

Also clarify the refund and return policy of these channels: If the product is not what is claimed or is defective or if you are not happy with it, will they take responsibility for taking it back ( at their cost) and refunding the money? If so, within how many days? Check the time taken for delivery too. Can you pay at the time of delivery? Buy only if you are convinced about their price and their policies.
