Orders summoning singers quashed
Saurabh Malik/TNS

Chandigarh, February 13
In what may sound music to the ears of so many of their fans, the Punjab and Haryana High Court today quashed the orders summoning renowned singers Anuradha Paudwal and Narinder Kumar Chanchal to face trial in a Copy Rights Act violation case.

Taking up a bunch of four petitions filed by the two singers and other petitioners, Justice Mehinder Singh Sullar also quashed the subsequent proceedings against them. The significance of the judgment can be gauged from the fact that the orders came some 15 years after the allegations of the Copy Right Act's violation were initially levelled against them. Proceedings for declaring Paudwal proclaimed offender too had been initiated.

She and other petitioners had sought the quashing of the complaint by Brij Mohan Bhardwaj and the summoning orders issued by Amritsar Chief Judicial Magistrate on January 11, 1997.

The CJM, vide the orders, had directed her to stand trial for the Act's violation under Section 420 of the IPC. Directions were also sought for quashing non-bailable warrants of arrest issued against Paudwal on September 16, 1999. Paudwal, through her counsel Hemant Bassi, had contended she "received the shock of her life when she learnt from media reports that she has been declared a proclaimed offender by the Amritsar CJM".

Going into the background of the controversy, the CJM had observed the complainant was the son of poet and writer Chaman Lal Ji Bhardwaj. Among the many books he had penned down was Chaman Ki Shree Durga Stutti published by Brij Mohan Bhardwaj Pustakalya, of which his son-cum-complainant was the proprietor.

The complainant had contended that the accused recorded and presented a video cassette in the market "Chaman Ki Shree Durga Stutti", which was an infringement of the Act. The CJM had added: "I find that prime facie it is imitation of the book published by Chaman Lal Ji Bhardwaj".

Appearing before Justice Sullar, Bassi said Brij Mohan Bhardwaj had "nowhere in his entire deposition deposed that the petitioner or for that matter any accused had any knowledge of the copy right, the infringement of which has been alleged by the respondent". He had added the summoning order was "totally without application of mind, as such was liable to be quashed".
