Chandigarh, January 16 State commission president Justice Sham Sunder and members Neena Sandhu and Jagroop Singh Mahal observed, “The order passed by the district forum, being based on correct appreciation of evidence and the law on the point, does not suffer from any illegality or perversity, warranting the interference of the commission.” Complainant Upkiran Kaur had submitted that she and her mother Amarjit Kaur, after a flat buyer’s agreement on December 15, 2006, were allotted apartment B-14-307 at the Rishi Apartments at Baddi for a total sale consideration of Rs 13,39,975. Amarjit Kaur, co-allottee, died on December 22, 2006. It was stated that Upkiran Kaur deposited Rs 16 lakh against the total sale consideration of Rs 13,39,975. The excess amount deposited by the complainant was adjusted towards the payments made by other family members for the purchase of apartment C6-401. The flat was to be handed over within 24 months of the date of signing the agreement. The opposite parties had failed to hand over possession. The district forum, in its order dated November 22, 2011, directed opposite parties to refund Rs 13,39,975, with 18 per cent per annum as interest from the date of the respective deposits till realisation, and Rs10,000 as costs of litigation. The counsel for the opposite parties, while filing an appeal against the order, pleaded that the complainants were not consumers and as the apartment was to be purchased for commercial purposes, the forum did not have the jurisdiction to entertain the complaint. It was stated that construction was started immediately after January 4, 2008, following environment clearance. It was further stated that the completion certificate was requested from the authority concerned on February 18, 2009. The counsel also stated that the complainants were offered possession of another apartment on on July 13, 2009, but they refused to take possession of the apartment offered. The opposite parties averred that Upkiran Kaur neither visited India, nor signed the agreement. They added that they had applied for approval, permission and sanction, but as those were not granted in time, there was no liability on their part. |

Chikkarangappa to sweat to defend title

PCA against U-21 players for shortest version

Bindra. MP Pandove, honorary secretary, the PCA and former member of the senior national committee of the BCCI said, “The shortest version of the game is distracting players for acquiring the skills necessary for playing in the longer version of the game (five and four-day matches). The shortest version of the game being played by the junior players is causing this
damage.” Pandove added, “The decision of the administrative committee will be put in the next executive committee meeting for ratification.” |

Chandigarh, January 16 For Maharashtra, AB Chinte and SS Bachhav claimed three wickets each. Maharashtra after gaining a crucial first innings lead started their second innings with VH Zol and CG Khurana who made 182 for no loss in 41 overs. CG Khurana scored an unbeaten century off 127 studded with eight boundaries and two sixes while his partner VH Zol scored an unbeaten 73 off 125 studded with four boundaries and two sixes. Scores Maharashtra (first innings): 399 for all in 57 overs.
