Tribune News Service

Chandigarh, December 14
Acting on a petition challenging BJP candidate Raj Kishore’s candidature for the municipal corporation (MC) poll from ward 19, the Punjab and Haryana High Court today stayed the declaration of result from the ward.

Issuing a notice of motion, the Bench also made it clear that the election would be held as per schedule. The directions by Justice Mehinder Singh Sullar came on a petition filed by local resident Ravi.

In his petition, Ravi had claimed that Raj Kishore could not be included in the Scheduled Caste (SC) category here as he was not mentioned therein, though he was included in the SC category in Bihar.

The High Court had earlier directed the returning officer to decide the issue within a week on merit. The petitioner’s counsel, Manu K Bhandari, contended that the returning officer dismissed the petition, but not on merit. The case would now come up on January 6 for resumed hearing.

The Bench, on the previous date of hearing, had observed, “After hearing the counsel for the petitioner, going through the record, with his valuable assistance, considering the entire matter deeply, without expressing any opinion on the merits of the case and taking into consideration the nature and urgency of the matter, the writ petition is disposed of, with the direction to the returning officer, Election Commission, Chandigarh, to treat copy of writ petition filed by the petitioner as representation and to take appropriate action, in accordance with law, within a period of one week positively, from the date of receipt of the certified copy of this order.”

Institute told to refund fee
Tribune News Service

Chandigarh, December 14
The District Consumer Disputes Redressal Forum-II has directed Swami Vivekanand Institute of Engineering and Technology to refund Rs 42,480 after deducting administrative charges of Rs 1,000 to a Sector-17 resident.

The forum comprising president Lakshman Sharma and members Madhu Mutneja and Jaswinder Singh Sidhu has also directed the opposite party to pay Rs 10,000 as compensation, besides Rs 7,000 as costs of litigation to the complainant.

The complainant, Ashima Soni, submitted that she took admission in Swami Vivekanand Institute of Engineering and Technology for academic session 2009-2010 and deposited Rs 43,480 as fee on July 12, 2009. She averred that on August 9, she got admission in another college in electronics and communication stream. She added that as she never attended any class, she immediately approached the opposite party on August 10, 2009, asking the latter to refund her fee, but to no avail. She said the opposite party also failed to refund the fee even after serving a legal notice on April 21, 2010.

The counsel for the opposite party pleaded that she left the course after joining the course for a few days. As per record of the opposite party, the complainant surrendered the seat on August 4, 2009, due to personal reasons and the complainant was not entitled for the refund of fee under AICTE Rules, as the seat surrendered by her remained vacant for the whole session.

The forum observed that as per instructions issued by the AICTE, it was apparent that the universities, including deemed universities and technical institutions, were duty bound to refund the fee in the event a student withdraws before the start of the course. The notice issued by the Registrar, Punjab Technical University, Jalandhar, said the counselling for the existing vacant seats was held from September 7. So it was evident that the course had not started by that date and under such circumstances, the complainant was entitled for the refund of full fee deposited by her after deducting Rs 1,000 as administrative charges.
