Insurance co. told to pay claim, fined
Rs 15,000
Chandigarh, November 11 The complainant, Ashish Pandhi, a resident of Panchkula, got a Bajaj Pulsar motorcycle insured with the company for a sum of Rs 61,816. The insurance policy was valid from July 24, 2009 to July 23, 2010. On May 24, 2010, a prospective buyer approached the complainant with intent to purchase the motorcycle and requested for a test drive. The complainant in good faith handed over the bike to him but the latter fled with the vehicle. Thereafter, the police submitted an untraced/final report. The company, in a written statement, pleaded that the act of the insured of handing over the key to the vehicle to a stranger and allowing him to take a test drive was in violation of the policy conditions. The insured should have taken all reasonable steps to safeguard the vehicle from loss and by allowing the stranger to take the test drive of the vehicle, the complainant had endangered the safety of the vehicle. The forum, comprising its president PD Goel and members Rajinder Singh Gill and Dr Madanjit Kaur Sahota, observed that the complainant had taken the comprehensive insurance policy and got the vehicle in question insured for Rs 61,816. Admittedly, the theft of the vehicle had been taken place during the currency of the insurance policy in question. So company was under legal obligation to reimburse the entire amount irrespective of the fact that the vehicle was being run in violation of the terms and conditions of the insurance policy. |
