2 hurt in accident
Lalru, August 24 Harjinder Singh of Bhagwanpur village near Dera Bassi and his cousin Raghbir Singh were injured when a mini-truck hit the motorcycle they were riding near Gholumajra
village on the national highway. Truck driver fled from the spot after the accident. The injured were admitted to the Dera Bassi Civil Hospital. The police has registered a case against unidentified truck driver under Sections 279, 337, 338 and 427 of the IPC.

HC asks CHB, Parsvnath to clear stand on refund
Chandigarh, August 24 The High Court has, in fact, asked their counsels to file detailed affidavits. Taking up the matter, the High Court asserted: “The dispute, in brief, is for the refund of amount deposited by the petitioner for the allotment of a plot. For reasons that need not be dilated, the project between Parsvnath Developers Limited and the CHB could not reach fruition, leaving the allottees without a flat and without hope of ever recovering their money.” “As admitted by the CHB, they have received Rs 516 crore from Parsvnath Developers Limited towards the bid amount and Rs 81.93 crore from the allottees and deposited in an escrow account operated jointly by the builders and the CHB. The money in this account is to be shared in the ratio of 70:30 between the builder and the CHB. The counsels for Parsvnath Developers and the CHB are directed to file their respective affidavits with respect to the assertions,” the court held. The developers and the CHB are in the dock before the Consumer Dispute Redressal Commission also for not repaying money to the depositors, despite orders. One of the depositors, Sudeep Budhiraja, has again moved the Commission by filing an execution application against the developer and the CHB. Acting on the application, the commission has issued notice to the respondents. The application seeks directions to the developer and the CHB to comply with the commission order of October 27, 2010. In the application filed through counsel Naresh Kumar Bansal, Budhiraja has asserted that his application for repayment of money was decided in his favour on October 27, 2010. Directions were issued for the payment of amount with interest and compensation. However, both Parsvnath and the CHB filed appeals before the National Consumer Dispute Redressal Commission. On April 29, the national commission passed an interim order in favour of complainant and other depositors with a direction to the housing board to return 85 per cent amount to the depositors within six weeks. Bansal added that the balance was to be deposited with the UT State Commission within eight weeks. The hearing on both the appeals before the national commission was also adjourned to September 8. However, both the parties failed to deposit the amount as per the interim order dated April 29. They even failed to pay amount with interest and compensation, as per order passed by the UT State Commission Chandigarh on October 27. |

Clinics liable to provide emergency services: HC
Chandigarh, August 24 For, a Division Bench has upheld the provisions of the Clinical Establishments (Registration and Regulation) Act, 2010, which makes such a facility mandatory. The ruling came on a petition filed by Dr Ramneek Singh Bedi and another medical practitioners having their clinics. In their petition, they had sought declaration that the Act was ultra vires or beyond the powers of the Constitution. They had contended the Act lays down the requirement of seeking registration, and provides for penal consequences in the absence of registration. Quoting Section 12 (2) of the Act, the petitioners contended it requires “facilities to stabilise the emergency medical condition of any individual who is brought to clinical establishment”. Taking up the matter, the Bench of Acting Chief Justice Adarsh Kumar Goel and Justice AK Mittal observed: "According to the counsel for the petitioners, the requirement of providing facilities for stabilisation of emergency medical condition of an individual is arbitrary and interference with the right of the petitioners to carry on their profession. “The petitioners are only running their clinics and they may not be able to provide for facilities for stabilising the emergency medical condition of individuals who are brought to such clinics. Those who cannot provide such facilities cannot be debarred from carrying on their medical profession”. After considering the submissions, the Bench asserted: “We are unable to accept the submission…. An individual medical practitioner may not be expected to do something impossible by providing facilities at par with a
big hospital. Interpretation of a statutory provision depends upon situation which
may arise. The provisions of the Act do not create any impossible situation so as to affect the right of the petitioners to practice the medical profession. “There is, thus, no ground to interfere at this stage. The individual fact situation can be considered as and when the same arises. The writ petition is dismissed”. |

Chandigarh resident convicted of murder
Panchkula, August 24 Amit was convicted for murdering Maan Singh, a resident of Daria village, Chandigarh. Those who were acquitted were Akash, Munish, both residents of Sector 27, Chandigarh, Vishnu, a resident of Sector 11, Chandigarh, and Pradeep, a resident of Indira Colony. The quantum of the sentence would be pronounced on August 26. On February 15 last year, the police had found the body of Maan Singh on the Saketri Road, near Mansa Devi Complex. The genitals of the deceased were badly damaged and marks of tyres of a four-wheeler indicated that Maan Singh was killed at some other place before the body was disposed off at an isolated place. The Panchkula Police contacted the police of the neighbouring areas with pictures of the deceased and found out that he was a resident of Daria village on the border of Chandigarh. Maan Singh was a labourer and had been living in a small tenement. According to the police, the murder was an outcome of a dispute over the possession of a house where Maan Singh used to stay. It was on the night of February 14 last year when the accused took him in a car and killed him, hitting with wooden planks. Later the body was dumped in a pit on the Saketri Road. |

3 booked for fraud
Chandigarh, August 24 Dinesh Dudreja, a resident of House No. 905, Sector 10, Panchkula, alleged that Karanveer Singh Maan, a resident of Sector 21, Panchkula, took Rs 1 crore for selling a house. The amount was taken as a deed to sell him House No. 69, Sector 19. However, the sale deed was not executed due to attached forged documents. In another case, Hardarshan Kumar, a resident of Ludhiana, alleged that Surjit Singh and Narinder Singh, both resident of Sector 34-C, Chandigarh, cheated him. He complained that Rs 1.61 crore was taken from him in lieu of a deal of plot, but nothing was done. |

Five-yr-old raped
Chandigarh, August 24 In the first incident, parents of a five-year-old girl at an under construction site in PU near Sector 25 found her missing yesterday evening. The police was called and after the search, the girl was found in the bushes. She was without clothes and had injuries on her private parts. The medical examination at Government Multi-Specialty Hospital in Sector 16 confirmed rape. “We have got some leads and efforts are on to arrest the accused,” said inspector Gurmukh Singh, SHO, Sector 11 police station. In another incident, a resident of Vikas Nagar attempted to rape a six-year-old girl last night. The accused, Ram Dilas, was the girl’s neighbour and allegedly took her to his residence. He then attempted to rape her. The girl returned home and told the incident to her parents who informed the police. A case under Sections 376, 506 and 511 of the IPC has been registered at the Mani Majra police station. |

Panchkula, August 24 The accused, identified as Rakesh, Pankaj, Uttam and Uma, were produced in the local court here today. The victim had told the police that all four accused took her to a flat in the group housing society, Sector 20, after abducting her from New Delhi. It was alleged that Rakesh and Pankaj raped her repeatedly at the flat. |

2 held for robberies in autos
Chandigarh, August 24 The police arrested Kulwinder Singh alias Jony, and Gurtej Singh, alias Santy, both residents of Mundi Kharar. The duo used to pick up passengers from the Sector-17 ISBT for Mohali and Kharar on stolen three-wheelers by fixing fake number plates on them. They then used to
rob them of all their belongings. DSP Satbir Singh said a team of the crime branch apprehended the accused near the PCA cricket stadium chowk. The police recovered two three-wheelers bearing fake registration numbers (PB-65-E-5848 and PB-65-F-2188) from their possession. A case under Sections 420, 468, 471, 473, 474, 411 and 120-B of the IPC has been registered at the Sector-17 police station. Out of these two three-wheelers, one was stolen from Kharar. The police said the accused belong to poor families. Accused Kulwinder Singh studied up to class VIII and Gurtej Singh is a class XII pass out. They were remanded in police custody. |

Two more cheating cases against immigration firm
Mohali, August 24 According to the police, Davinder Kumar, a resident of Rajpura, had complained that he had allegedly given Rs 1 lakh to the owner of the company, Deepak Arora, for going abroad. He was neither sent abroad and nor was the money returned
to him. In another case Jaswinder Singh of Dhobar village in Ludhiana district had complained that he had given Rs 1.20 lakh to the owner of the company for sending him abroad. The needful was not done and even the amount was not returned to him. The police has registered cases under Section 420 of the IPC and Section 24 of the Immigration Act in this regard. Two youths arrested
for robbery Zirakpur: The Zirakpur Police has arrested two youths for robbing Rs 1,800 and a mobile phone from an employee of a farmhouse in Peermuchhalla after training an air pistol and a knife at him last night. A case has been registered against five persons on the complaint of Sawaran Ram, hailing from Bihar and presently working at the farmhouse in Peermuchhalla. The arrested accused has been identified as Sonu, alias Thanda, and Ashok, both residents of Rajiv Colony, Panchkula. Ravi, Chaman Lal and an unidentified man were still at large. The investigating officer stated that complainant Sawaran Ram alleged that he was returning to his home around 11 pm when the accused stopped him and allegedly robbed him. After getting details about the accused, a police
team raided the possible hideouts and arrested the accused from Panchkula, the investigating officer added. The police team recovered an air pistol from their possession and the accused would be produced in the court tomorrow, he added. Theft Thieves decamped with jewellery, cash and other valuable items after breaking into a house at Gurjeevan Vihar, Dhakoli. The owner of the house, Deep Khanna, said he went to Delhi along with his family. When he returned on August 18, he found that the lock of the main door was broken. The thieves ransacked the house. The owner claimed that Rs 1.5 lakh cash and gold and silver jewellery worth lakhs of rupees were missing. A case has been registered. One held for accepting bribe Ambala: The vigilance bureau, Ambala, has nabbed an officer of the Instrument Design Development and Facilities Center (IDDC) at Ambala Cantt for allegedly taking bribe of Rs 25,000 from a factory owner. According to information, Punit Kapoor, a factory owner of Ambala Cantt had complained to the vigilance bureau that deputy engineer of the IDDC Madan Singh was demanding Rs 25,000 from him for not taking strict action against him on a complaint. The raiding party recovered the amount from the possession of Mandan Singh. The bureau has registered a case against him under the Prevention of Corruption Act. |
