HC no to vacate stay on construction of Tata project
Chandigarh, July 26 As the case came up for resumed hearing this morning, Acting Chief Justice Adarsh Kumar Goel and Justice A K Mittal did not favour the plea by the counsel for Tata Housing Development Company for the vacation of stay. The case also saw counsel for the State of Punjab seeking time to file a report on the project. The counsel for the petitioner in the case also informed the Bench that the master plan for the City Beautiful, being prepared by Chandigarh, along with the States of Punjab and Haryana, should soon be completed. The counsel claimed that once the master plan was complete, the picture with regard to the Tata Camelot project would become clear, as the master plan would give a finding on the project. He added that a public interest litigation on the preparation of the master plan was coming up for resumed hearing in the first week of September. The Bench, as such, should adjourn the case challenging the Camelot project to any date after the hearing of the PIL. The case now stands adjourned to second week of September. The Bench, on the previous date of hearing, had segregated the Tata Camelot case from the master plan matter. Senior counsel appearing for Tata Housing Mukul Rohatgi had requested the court to hear the matter for vacation of the interim stay on the project, while pointing out that the project approvals were taken under an existing master plan. In an affidavit filed before the court, Tata also defended its upcoming multi-storey project at Kansal village. The affidavit said the project neither fell in the catchment area of the Sukhna Lake, nor was it in the violation of Punjab’s New (Periphery) Control Act. The High Court had earlier heard that the environmental clearance to the Housing Project had not been accorded; as such the construction could not commence at the site. The affidavit, by the Director, Northern regional office of Ministry of Environment and Forests, categorically said it had not accorded the environmental clearance. Elaborating, the affidavit said the project was located within the 10 km periphery of Sukhna wildlife sanctuary. Hence, a clearance would also have to be obtained from the standing committee of National Board for Wildlife, in addition to environmental clearance before the work could commence on the site. |
