HC issues notice to Centre on Capt Kohli’s death
Tribune News Service

Chandigarh, July 14
Acting on a petition filed by Capt Sumit Kohli’s sister Namrita for an independent probe into his death a few months after he was awarded the Shaurya Chakra, the Punjab and Haryana High Court today issued a notice of motion to the Union of India.

Justice K Kannan also fixed November 8 as the next date of hearing in the case.

Seeking an independent inquiry into the mysterious death, Namrita’s counsel Ranjan Lakhanpal contended that the Kohli family had received a letter by an Army officer alleging Captain Kohli was murdered.

“The letter shows Sumit Kohli had expressed apprehension to his life from a commanding officer who was responsible for a number of fake encounters and other illegal acts committed by him and some other officers,” Lakhanpal contended.

Disputing the claim by the Army authorities that Kohli had committed suicide, Lakhanpal asserted that “it is not understandable as to how three empty shells were found at the place if there was only single shot injury”.

The petitioner also referred to two medical reports that were “contradictory”. As per one report, the entry wound was on the left side of the chin and as per the second, the entry wound was on the right side of the chin.

The petition says the family was not provided with the inquiry report. When the family moved an application under the RTI Act, the information was denied on the ground that the Act was not applicable in Jammu and Kashmir.

After the petitioner and her family moved the Delhi High Court, the inquiry report was provided. The petitioner has also attached the photographs taken at the time of Captain Kohli’s death in an attempt to show he was shot from point blank.
