Insurance company told to pay claim of ~ 27,750
Chandigarh, July 11 The forum rejected the contention of the insurance company for denying the claim on the grounds that the goods were indemnified for “burglary and housebreaking” and not theft. Taking the plea of legalities between “theft” and “burglary”, the latter involves violence and use of force, a technical difference that a common man may not know, the insurance company had repudiated the claim of the dhaba owner. In his complaint, Tehal Singh stated that he had insured ACs, refrigerators and other kitchen equipment, installed in his dhaba with the insurance company for one year from March, 2007. On the intervening night of April 29 and 30, 2007, three AC units installed on the roof of the dhaba were stolen. Though the complainant completed the required formalities, the insurance company rejected the claim on the grounds that theft was not covered under the terms and conditions of the policy. In their reply to the forum, the company stated that it was liable for paying claims for any loss or damage only in case of burglary or housebreaking and since no forcible entry or exit was made on the complainant’s premises, the claim was unmaintainable. Relying on the observations made by the apex court in the case of United India Insurance Co Ltd versus Harchand Rai Chandan Lal (2004), wherein the Supreme Court refused to disturb the payment ordered by a consumer forum in a similar case and upheld by the State Commission and the National Commission, the UT forum directed to the insurance company to settle Tahal Singh’s claim. Though the Supreme Court had allowed the appeal of the insurance company and observed that “in absence of violence of force, the insurer cannot claim indemnity against the insurance company”, it made a suggestion to the insurance company that terms of the policy be suitably amended so that burglary is given a meaning closer to the realities of life and the common man is not tripped up merely on technical grounds. |

AC hostels for sportspersons
Patiala, July 11 Players are extremely delighted with the decision and are all praises for the university authorities. Archer Jasbir Singh said this was a genuine step keeping in mind the weather. “We start our training at 5.30 in the morning and practice the entire day, except three-hour rest in the afternoon. The weather is so hot and humid that despite such a hectic schedule and being tired, we could not get a sound sleep. Air conditioners had certainly made the situation better,” he added. Director sports, Punjabi University, Patiala, Dr Rajkumar Sharma, said, “The basic motive is providing better facility to players. It is our prime duty to provide better facilities to them, as they are the one who bring laurels to the country.” — TNS |
Facilities yes, but for select few
Chandigarh, July 11 No doubt the facilities are being provided to players but those facilities are accessible to players of selected games only. The players in sports academies have top-class facilities, but the players in schools are yet to have the basic infrastructure. The players are left with no other option but to move to coaching
centres, where a single coach supervises them at the same time. Interestingly, on one hand, games like chess,
choi-kwang-do, table soccer, throwball, kho-kho, carrom, roller hockey, roller skating, sqay martial arts, yoga,
dodgeball, kabaddi, wushu, ball badminton, circle kabaddi, karate, netball, rope skipping, soft tennis, sepak
takkra, tennis ball cricket, kick boxing, thang ta martial arts, ghatka, tug of war, jump rope, football tennis, tennis volleyball, jeet kune do, cycle polo and cricket T-20 are included by the School Games Federation of India
(SGFI) in the upcoming School National Games, on the other hand, these are not counted under the gradation system conducted by the UT sports department. This lack of communication led the sports to revolve around academies only. As being the centre of attraction, the players in these academies are achieving new heights, leaving behind a general sportsperson studying in a city-based school. According to experts, the “infrastructure” for other games will remain in the files of the higher level, as they always promise but fail to fulfill them. The sports department looks after sports academies, whereas the education department has its own sports body. The games like basketball, softball, archery,
kho-kho, kabaddi, athletics and many more can easily be seen vanishing from the priority list of the authorities. “We are aware of the situation and certainly there is a need to take action. It is the duty of school principals but they concentrate more on other things rather taking action on the situation of the infrastructure for sports. We are working on it and will surely come up with a proper plan soon,” said VK Singh, finance-cum-sports secretary, on the poor condition of infrastructure for sports in schools. Adding further, he said the schools could not compete with the sports academies in the tournaments, as the schools lack professional coaches. But the authorities failed to depute or appoint any full-time professional coaches of SAI or any other organisation in the government schools of the city. According to the experts, there is a need of proper understanding between both authorities for the uplift of sports. There are over 52 government schools in the city but none of them has ever defeated the 20-member squad of the academy in the inter-school tournaments over the past years. ”The authorities might have adopted policies for some games but the players of kho-kho and kabaddi are not included under gradation system” said DS
Kholi, kho-kho coach. Both UT sports department and UT education department continue to make tall claims of having the best sports facilities but both authorities have never made an effort to come on a single platform to uplift the
sports.
