UT administration’s order rejecting allotment of booth quashed
Chandigarh, July 1 The assertion came on a petition filed by a booth owner, Raja Ram Singh, against the UT Chief Administrator. Holder of a handcart licence, Singh was allotted a rehri parking site in Sector 22-D Bijwara Market before being asked to deposit Rs 3,000 with Chandigarh Housing Board as earnest money for allotment of a booth. In his petition before the High Court, Raja Ram claimed that he was legally entitled to allotment of a built-up booth in the Sector 22-D rehri market but his claim was rejected on November 11, 2007. Giving reasons behind the rejection, he said at the time of inspection, Manohar Lal was found selling clothes at the site. On the basis of this report, the screening committee expressed view that the scheme’s benefit could not be passed on to “wrong hands”. Allowing his petition, Justice Ranjit Singh asserted: “The only ground to deny the claim of the petitioner is that he was found not working at the booth.” Justice Ranjit Singh added that before issuing notice on his plea, the court satisfied itself on the issue by going through a number of bills produced on record to show he had been purchasing clothes from agencies for selling at his booth. Justice Ranjit Singh further added: “Once the issue was argued before this court, a local commissioner was detailed, primarily on the asking of the counsel for the respondents. He has found that the petitioner is in continuous possession of the booth for so many years…. “Now to contest the right of the petitioner and stand on prestige against lowly placed person, who is running a booth does not speak well of the Union Territory Administration. I am of the considered opinion that the petitioner has made out a case for reallocation of the booth to him and the order, rejecting his claim may not be sustainable in view of the factual position now noticed. “The writ petition is, therefore, allowed and impugned order rejecting the allotment of booth to the petitioner is hereby quashed.” |
