In his complaint, Rajesh had stated that he had taken one year Marine Open Policy of Rs 50 lakh from the company in August 2009 after paying a premium of Rs 13,789. The insurance covered theft, pilferage, non-delivery and destruction due to strikes, riots and civil commotion besides rail/road risks. He stated that he dispatched a consignment of 592 boxes of apples on October 10, 2009 from Chandigarh to Hyderabad costing Rs 7.9 lakh. It was sent through a truck of Link Roadways. However, the consignment did not reach the destination on the scheduled date i.e. October 16. The complainant lodged a police complaint on October 22. Subsequently, he filed a claim with insurance company with requisite documents. He also filed the monetary claim with Link Roadways. As the insurance company failed to settle his claim, the complainant approached the forum. In its reply, the insurance company stated that they had not received any information from the complainant regarding the dispatch of consignment of apples from Chandigarh to Hyderabad. Further, there was a collusion between the complainant and Link Roadways, whose truck was used for transportation. In case of any loss to the complainant, the roadways were liable to pay. As Link Roadways refused to accept the notice, they were proceeded against ex parte. The forum, comprising president, Lakshman Sharma, and members Ashok Raj Bhandari and Madhu Mutneja, rejected the contention of the insurance company that the consignment was not booked by the complainant as the complainant produced the copy of marine declaration form submitted to the company. The forum stated that despite submitting the claim for his loss with all necessary documents in time, the company failed to settle the complainant’s claim, so they were liable to pay Rs 7.9 lakh, value of consignment, along with compensation and cost of litigation to him. |
